Res 11-80 RESOLUTION NO. 11-80 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, ACCEPTING ALL THE STREETS AND STORM DRAINS INSTALLED IN RAINBERRY LAKES, PHASE TWO AS RE- CORDED IN PLAT BOOK 37, PAGES 94 & 95 OF THE PUBLIC RECORDS OF PALM BEACH COUNTY, FLORIDA, AS OPERATIONAL; PROVIDING THAT THIS RESOLUTION SHALL NOT DISCHARGE THE DEVELOPER FROM STRICT PERFORMANCE; PROVIDING FOR MAIN- TENANCE FOR AND REPAIRS BY THE DEVELOPER FOR ONE YEAR. WHEREAS, Wantman & Associates, Inc., Consulting Engineers and Land Surveyors for the above mentioned project have certified all streets and storm drains as shown on their approved plans for said project have been completed and ready for use by the public; and, WHEREAS, the said streets and storm drains were inspected and approved by the City of Delray Beach Engineering Department~ NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That all streets, storm drains and related facili- ties have been installed in Rainberry Lakes, Phase Two as recorded in Plat Book 37, Pages 94 & 95 of the Public Records of Palm Beach County, Florida, and are hereby accepted by the City of Delray Beach as being operational, and shall become effective upon the date of passage and adoption of this resolution. Section 2. That nothing contained herein shall be construed as discharging the developer, Carole Siemens, Trustee, from strict performance of her remaining contractual obligations and duties, and that her bond (escrow account) shall remain in effect in all respects until released in accordance with her agreement with the City. Section 3. That the Developer, Carole Siemens, Trustee, shall be responsible for maintenance and repairs of all the streets and storm drains for a period of one year after acceptance of this resolution by the City of Delray Beach Council.
