Res 28-80 RESOLUTION NO. 28-80 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, SUPPORTING THE CITY OF NORTH MIAMI IN URGING THE FLORIDA LEGISLATURE TO PROVIDE REGULATION OF THE ROUTINE USE OF ACOUSTIC WARNING DEVICES BY RAILROADS AT GRADE CROSSINGS WHERE ADEQUATE ALTERNATE WARNING DEVICES EXIST AND URGING THE FLORIDA EAST COAST RAILROAD TO UPGRADE THEIR GRADE CROSSINGS IN THE CITY OF DELRAY BEACH; AUTHORIZING THE CITY CLERK TO FURNISH COPIES OF THIS RESOLUTION TO ALL APPROPRIATE PUBLIC OFFICIALS AND AGENCIES. WHEREAS, the City Council of the City of Delray Beach, Florida, has been requested by the City of North Miami to join with them in urging the Florida Legislature to provide noise pollution protection against the sounding of acoustical warning devices by railroads in residential areas at crossings which are already properly guarded; and, WHEREAS, this noise problem is common to both the City of Delray Beach and the City of North Miami; and, WHEREAS, the City Council of the City of Delray Beach, Florida, on behalf of the residents and citizens of the City of Delray Beach, wishes to support the efforts of the City of North Miami in urging the Florida Legislature to alleviate this noise problem, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That the City Council of the City of Delray Beach, Florida, hereby supports the efforts of the City of North Miami in reduc- ing railroad noise, and urges the Florida Legislature to enact legislation regulating the routine use of acoustic warning devices by railroads at grade crossings where adequate alternate warning devices exist. Section 2. That the City Council of the City of Delray Beach, Florida, hereby urges the Florida East Coast Railroad to upgrade their various grade crossings within the municipal limits of the City of Delray Beach for the betterment of the entire community. Section 3. That the City Clerk is hereby authorized and directed to furnish copies of this resolution to all appropriate public officials and agencies and to the appropriate officials of the Florida East Coast Railroad.
