A RESOLUTION OF THE CITY COUNCIL OF THE CI~TY OF DELRAY
BEACH, FLORIDA, REQUESTING PERMISSION FROM THE BOARD OF
COUNTY COMMISSIONERS, PURSUANT TO FLORIDA STATUTES
171.062, TO REZONE LAND TO BE ANNEXED TO THE CITY OF
DELRAY BEACH FROM THE COUNTY ZONING CLASSIFICATION CG
(GENERAL COMMERCIAL) TO THE CITY'S ZONING CLASSIFICATION
RM-15 (MULTIPLE FAMILY DWELLING) DISTRICT.
WHEREAS, the City of Delray Beach has received a request for
annexation from JKL Development Corp., the owner of the following
described property:
A parcel of land in Section 21, Township 46 South, Range 43
East, Palm Beach County, Florida, more particularly described
as follows:
Beginning at the intersection of the easterly right-of-way
line of State Road No. 5 (U.S. Highway No. 1) with the south
line of Lot 7, Block 1 of Model Land Company's Subdivision
of the West Half of Section 21, Township 46 South, Range 43
East, as recorded in Plat Book 1, Page 128, of the Public
Records of Palm Beach County, Florida; thence easterly along
the south line of said Lot 7, 315.60 feet, more or less, to '
the southeast corner of said Lot 7; thence continuing
easterly along the easterly extension of the south line of
Lot 7, 82.62 feet to a point in Lot 11, Block 1 of said
subdivision; thence northerly, parallel to, and 82.62 feet
easterly from, the west line of said Lot 11, 331.15 feet to
a point in the easterly extension of the north line of the
south half of said Lot 7; thence westerly along said easter-
ly extension, 82.62 feet to the west line of said Lot 11;
thence continue westerly along the same course, and along
the north line of the south half of said Lot 7, 109.69 feet,
more or less to a point in the easterly right-of-way line of
said State Road No. 5; thence southerly along said easterly
right-of-way line, 392.50 feet, more or less, to the point
of beginning, being 2.244 acres more or less, LESS the south
20 feet thereof.
LESS that portion thereof deeded to the State of Florida as
recorded in Deed Book 1073, page 164, Palm Beach County,
Florida, more particularly described as follows:
A strip of land 45 feet in width, lying adjacent to, Easter-
ly of and measured at right angles to the Easterly Right-of-
Way line of State Road 5 across the South half of Lot 7,
Block 1, Model Land Company's Map of Section 21, Twp. 46 S.,
Rge. 43 E., as recorded in Plat Book 1, page 128, Palm Beach
County Public Records, LESS the South 20 feet thereof;
and,
WHEREAS, the City Council upon the favorable recommendation of
the Planning and Zoning Board has considered this annexation request and
approves annexation of the subject parcel; and,
WHEREAS, in order for this parcel to be zoned to the City Zoning
classification of RM-15 (Multiple Family Dwelling) District upon annex-
ation, it is necessary under Chapter 171.062 of the Florida Statutes for
the City to request permission from the Board of County Commissioners of
Palm Beach County, Florida, for the change in zoning of this parcel, which
is currently zoned CG (General Commercial) in the County,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That the City Council hereby requests permission from
the Board of County Commissioners of Palm Beach County to rezone, when
annexed, the property described above from CG (General Commercial) to
RM-15 (Multiple Family Dwelling) District which will result in an increase
in the density al lowed in such land.
Section 2. That a certified copy of this resolution is being
sent to each member of the Board of County Commissioners, the County
Administrator and the Director of Planning, Zoning and Building.
PASSED AND ADOPTED in regular session on this the 13th
