Res 90-80 RESOLUTION NO. 90-80 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, REQUESTING PERMISSION FROM THE BOARD OF COUNTY COMMISSIONERS, PURSUANT TO FLORIDA STATUTES 171.062, TO REZONE LAND TO BE ANNEXED TO THE CITY OF DELRAY BEACH FROM THE COUNTY ZONING CLASSIFICATION AG (AGRICULTURAL) DISTRICT TO THE CITY'S ZONING CLASSIFI-- CATION LI (LIGHT INDUSTRIAL) DISTRICT. WHEREAS, the City of Delray Beach has received a request for annexation from Robert D. Horner and Virginia M. Horner, his wife, the owners of the following described property: A parcel of land in the Northeast Quarter (NE¼) of Section 30, Township 46 South, Range 43 East, Palm Beach County, Florida, described as follows: The East 402.00 feet of that part of the North half (N½) of the said Northeast quarter (NE¼) of Section 30 lying West of the S.A.L. Railroad, less that portion North of the South right-of-way line of Germantown Road and less the right-of-way for Congress Avenue. and, WHEREAS, The City Council upon the favorable reccmmendation of the Planning and Zoning Board has c~nsidered this annexation request and approves ann~ation of the subject parcel; and, WHEREAS, in order for this parcel to be zoned to the City Zoning classification of LI (Light Industrial) District upon annexation, it is necessary under Chapter 171.062 of the Florida Statutes for the City tc request permission frcm the Board of County Commissioners of Palm Beach County, Florida, for the change in zoning of this parcel, which is cur- rently zoned AG (A~gricultural) in the County, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEA~, FLORIDA, AS FOLLOWS: Section 1. That the City Council hereby requests pe~]ission frcm the Board of County Commissioners of Palm Beach County to rezone, when annexed, the property described above from AG (Agricultural) to LI (Ligh~ Industrial) District which will result in an increase in the density al- lowed in such land. Section 2. That a certified copy of this resolution is keing sent to each member of the Board of County Commissioners, the County Administrator and the Director of Planning, Zoning and Building.
