A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY
BEACH, FLORIDA, VACATING AND ABANDONING A PORTION OF
GEP~'IANTO~ ROAD LYING BETWEEN CONGRESS'AVENUE AND THE
SEABOARD COAST LINE RAILROAD IN SECTION 30, TOWNSHIP 46
SOUTH, RANGE 43 EAST.
WHEREAS, Robert D. Horner and Virginia M. Horner, his wife, are
the fee-simple owners of a parcel of land in the Northeast Quarter (NE-~)
of Section 30, Township 46 South, Range 43 East, Palm Beach County,
Florida described as follows:
The East 425.00 feet of that part of the North Half (N½) of the said
Northeast Quarter (NE¼) of Section 30 lying West of the S.A.L. Railroad,
less the South 200.00 feet of the North 253.00 feet of the West 248.00
feet thereof; and less the West 23 feet thereof for the Right-of-Way for
Congress Avenue; and less the Right-of-Way for Germantown Road; and less
the Right-of-Way for Linton Boulevard as shown on the Right-of-Way map for
State Road No. 9 (I-95) Section 93220-2411, Sheet 18-A;
and,
~'~HEREAS, Robert D. Horner and Virginia M. Horner, his wife, have
made application for abandonment of a portion of Germantown Road located
between Congress Avenue and the Sea. board Coast Line Railroad in Section
30, Township 46 South, Range 43 East; and,
WHEREAS, the City Council of the City of Delray Beach, Florida,
deems it to be in the best interests of the City of Delray Beach to vacate
and abandon said portion of Germantown Road,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That pursuant to Chapter 166 of the Florida Statutes,
it is hereby determined to vacate and abandon the following described real
pr ope r ty:
That portion of Germantown Road lying east of Congress
Aenue and west of the Seaboard Coast Line Railroad,
located in Section 30, Township 46 South, Range 43.East.
Section 2. That the abandonment of the portion of Germantown
Road as described in Section 1 be effected subject to the owner providing
a twelve (12) foot easement for Florida Power and Light Company's elec-
trical facilities and the owner removing existing pavement and reconstruct
intersection to a normal "T" configuration.
PASSED AND ADOPTED in regular session on this the 10th
day of November , 1980.
