Res 108-80 RESOLUTION NO. 108-80 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, VACATING AND ABANDONING THAT PORTION OF EGRET CIRCLE, JAEGER DRIVE AND QUAIL ROAD LOCATED BET~rEEN LINDELL BOULEVARD AND S.W. 4TH AVENUE, AS SHOWN ON THE PLAT OF TROPIC PALMS PLAT NO. 1, AS RECORDED IN PLAT BOOK 25, PAGES 99 THROUGH 102, INCLUSIVE, AND LINTON CENTER, AS RECORDED IN PLAT BOOK 39, PAGES 8 AND 9, OF THE PUBLIC RECORDS OF PALM BEACH COUNTY, FLORIDA. WHEREAS, the fee-simple owners of the property described in Section 1 below being Richard L. Schmidt, as Trustee, Charles E. Schmidt, Jr., as Trustee, Tartan Laver, Delray, Inc., a Florida Corporation formerly known as Maple Leaf Management & Development, Inc., a Florida Corporation, successor by merger to Tartan-Delray, Incorporated, a Florida Corporation and Laver's Delray Racquet Club, Inc., a Florida Corporation, have requested abandonment of that portion of Egret Circle, Jaeger Drive and Quail Road located between Lindell Boulevard and S.W. 4th Avenue, as shown on the Plat of Tropic Palms Plat No. 1, as recorded in Plat Book 25, Pages 99 through 102, inclusive, and L,inton Center, as recorded in Plat Book 39, Pages 8 and 9, of the Public Records of Palm Beach County, Florida; and, WHEREAS, the City Council of the City of Delray BeaCh, Florida, deems it to be in the best interests of the City of Dleray Beach to vacate and abandon said portions of Egret Circle, Jaeger Drive and Quail Road located between Lindell Boulevard and S.W. 4th Avenue, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That pursuant to Chapter 166 of the Florida Statutes, it is hereby determined to vacate and abandon the following described real pr ope rty: Ail that part of Quail Road, Jaeger Drive, and Egret Circle lying east of Lindell Boulevard and northerly of the following specifically described line: Commencing at a point on the southerly boundary of Parcel S-6 as shown on the Plat of Linton Center, according to the Plat thereof as recorded in Plat Book 39, Pages 8 and 9, Public Records, Palm Beach County, Florida, said point being the most northeasterly corner of Lot 501, Tropic Palms Plat No. 1, according to the Plat thereof as recOrded in Plat Book 25, Pages 99 through 102, inclusive, Public Records, Palm Beach County, Florida; thence, bear South 56°52'55'' West along the northerly line of said lot, a distance of 175.58 feet to the most southerly corner of said Parcel S-6 and the point of beginning, thence, continue South 56°52'55" West along said line, a distance of 60.00 feet to a point in the southerly right of way line of Quail Road as shown on said Plat of Tropic Palms; said point being on a curve concave southerly having a radius of 25.00 feet and whose radius point bears South 56°52' 55" West; thence, westerly along said curve and along said right of way line, through a central angle of 56°52'50'', a distance of 24.82 feet to the point of tangency; thence, North 89°59'55" West along the southerly right of way line of said Quail Road and its westerly prolongation, a distance of 613.20 feet to a point in the westerly curved right of way line of Jaeger Drive as shown on said Plat of Tropic Palms, said point being a point in a curve concave westerly having a radius of 234.94 feet and whose radius point bears South 73°39'56" West; thence, northerly along said curved right of way line, through a central angle of 23°25'46", a distance of 96.07 feet to a point of compound curvature of a curve concave southerly having a radius of 28.03 feet; thence, westerly along said curve and the southerly right of way line of Egret Circle as shown on said Plat of Tropic Palms, through a central angel of 84°01'52'', a distance of 41.11 feet to a point of reverse curvature of a curve concave northerly having a radius of 530 feet; thence, westerly along said curve and southerly right of way line of said Egret Circle, through a central angle of 33~47'47", a distance of 312.62 feet to the point of tangency; thence, North 89~59'55'' West along said right of way line, a distance of 141.03 feet to a point of curvature of a curve concave souther- ly having a radius of 785.30 feet; thence westerly along said curve and along the southerly right of way line of said Egret Circle through a central angle of 43"10'50'', a distance of 591.84 feet to the point of tangency; thence South 46°49'15" West, continuing along said right of way line, a distance of 151.08 feet to a point of curvature of a curve concave easterly having a radius of 25.00 feet; thence, southerly along said curve and said right of way line, through a central angle of 87~45'24'', a distance of 38.30 feet to the end of said curve and a point on the northeasterly curved right of way line of Lindell Boulevard, as shown on said Plat and the end of said specifically described line; Together with all of said Parcel S-6 excepting therefrom the easterly 30.00 feet thereof. Section 2.' That the abandonment of that portion of Egret Circle, Jaeger Drive and Quail Road as described in Section 1 above shall be effected subject to construction of a bike path along S.W. 4th Avenue along the entire eastern boundary of the Laver Development.
