Res 01-79 RESOLUTION NO. 1-79 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, ACCEPTING ALL THE SANITARY SEWERS, WATER UTILITIES, DRAINAGE AND PAVED STREETS IN THE HAMLET TRACT, KNOWN AS EVERGREENE SUBDIVISION AS RECORDED IN PLAT BOOK 33, PAGES 150 AND 151 OF THE PUBLIC RECORDS OF PALM BEACH COUNTY, FLORIDA, AS OPERATIONAL AND SETTING THE INITIAL SCHEDULE OF RATES, FEES AND OTHER RELATED CHARGES TO BE IMPOSED FOR THE SERVICES AND FACILITIES FURNISHED BY THE SAID UTILITIES, DRAINAGE AND PAVED STREETS. WHEREAS, the City Engineer of Delray Beach, Florida, has certified as operational (1) all sanitary sewers and related facilities (2) all the water mains and related facilities (3) all drainage facilities and (4) all paved streets in the Hamlet Tract known as Evergreene Subdivision as shown on the "As-Built" Drawingswhi~h have been presented by the designated Consulting Engineer, John A. Grant, Jr., as certified. WHEREAS~, the said sanitary sewer system and water facilities were inspected and approved as operational by the Public Utilities Department of the City of Delray Beach, Florida, WHEREAS, the said water facilities were inspected and approved by the Palm Beach County Health Department, Palm Beach County, Florida. WHEREAS, it is deemed to be in the best interest of the affected pro- perties that the initial schedule of rates, fees, and other related charges be imposed for the services and facilities furnished by the sewer systems, as set forth and contained per Part II, Chapter 27 Water and Sanitary Sewerage of the Code of Ordinances of the City shall become effective the first day of February, 1979. WHEREAS, the drainage facilities and paved streets were inspected and approved as operational by the City Engineering Department of the City of Delray Beach. WHEREAS, it is deemed to be in the best interest of the affected pro- perties that the streets and drainage facilities be turned over to the City of Delray Beach for maintenance after the one-year warranty from the time of accpetance by, the City Council of Delray Beach, Florida. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FL6RIDA, AS FOLLOWS: Section 1. 'That all (1) sanitary sewers and related facilities and (2) water mains and related facilities in the Hamlet Tract, known as Ever- greene Subdivision hereby be accepted by the City of Delray Beach as being operational and the initial schedule of rates, fees, and other charges previously established and applicable thereto, shall become effective on the first day of.February, 1979. Section 2.. That all (3) storm drains and facilities and (4) paved streets in the Hamlet Tract, known as Evergreene Subdivision hereby be accepted by the.City of Delray Beach as being operational and related fees and other charges for maintenance shall become effective on the first day of February, 1979. Section 3. That nothing herein contained shall be construed as dis- charging the developer from strict performance of his remaining contractual duties until released in accordance with his agreement with the City of Delray Beach, Florida. Section 4. That the developer shall be responsible for maintenance and repairs of the sanitary sewers, water facilities, drainage and paved streets for a period of one year after acceptance of this resolution by the City of Delray Beach Council.
