Res 31-79 RESOLUTION NO. 31-79 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, REQUESTING PERMISSION FROM THE BOARD OF COUNTY COMMISSIONERS, PURSUANT TO FLORIDA STATUTES 171.062, TO REZONE LAND TO BE ANNEXED TO THE CITY OF DELRAY BEACH FROM THE COUNTY ZONING CLASSIFICATION RS (RESIDENTIAL SINGLE FAMILY) TO THE CITY'S ZONING CLASSI- FICATION RM-10 (MULTIPLE FAMILY DWELLING) DISTRICT. WHEREAS, the City of Delray Beach has received a request for annexation from John D. Hardy and Yolanda Hardy, his wife, the owners of the following described property: Lots 45, 46 and 47, Block 35, Del Raton Park, according to the Plat thereof recorded in Plat Book 14, Pages 9 and 10, of the Public Records of Palm Beach County, Florida; and, WHEREAS, the City Council at the April 9, 1979, regular meeting considered this annexation request and upon the recommendations of the Planning and Zoning Board at the meeting held on March 27, 1979, feels that the proper zoning for this parcel of land would be the City's Zoning Classification RM-10 (Multiple Family Dwelling) District; and, WHEREAS, Chapter 171.062 Florida Statutes, requires that when a Municipality desires to annex property at a zoning classification, which would permit higher density than is currently in effect under County regulations, that the Municipality request and receive permission from the Board of County Commissioners for such a change, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That the City Council hereby requests permission from the Board of County Commissioners of Palm Beach County to rezone, when annexed, the property described above from RS (Residential Single Family) to RM-10 (Multiple Family Dwelling) District which will result in an increase in the density allowed in such land. Section 2. That a certified copy-of this resolution is being sent to each member of the Board of County Commissioners, the County Administrator and the Director of Planning, Zoning and Building.
