Res 34-79 RESOLUTION NO. 34-79 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, VACATING AND ABANDONING A PORTION OF JAEGER DRIVE, AS SHOWN ON THE PLAT OF TROPIC PALMS PLAT NO. 1, AS RECORDED IN PLAT BOOK 25, PAGE 102, OF THE PUBLIC RECORDS OF PALM BEACH COUNTY, FLORIDA. WHEREAS, Robert W. Gottfried, Inc., is the owner of Parcels E, F and G, Wenton Village, according to the plat thereof as recorded in Plat Book 30, page 33 of the Public Records of Palm Beach County, Florida (formerly a portion of plat of TROPIC PALMS PLAT NO. 1, as recorded in Plat Book 25, page 102)7 and, WHEREAS, Robert W. Gottfried, as President of Robert W. Gottfried, Inc., has appointed Laver's Delray Racquet Club, Inc., and Tartan Delray, Inc. contract vendees of said property, to act as agent in his behalf to accom- plish this vacation and abandonment; and, WHEREAS, Roy Rogers, as agent for Laver's Delray Racquet Club, Inc., and Tartan Delray, Inc., has made application for a vacation and abandonment of a portion of Jaeger Drive abutting said property; and, WHEREAS, the city Council of the City of Delray Beach, Florida, deems it to be in the best interests of the City of Delray Beach to vacate and abandon said portion of Jaeger Drive, NOW, THEREFORE, BE IT RESOLVED BY TH~ CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That pursuant to Chapter 166 Florida Statutes, it is hereby determined to vacate and abandon the following described real property A portion of Jaeger Drive, as shown on the Plat of TROPIC PALMS PLAT NO. 1, as recorded in Plat Book 25, Page 102, of the Public Records of Palm Beach County, Florida, described as follows: Beginning at the Intersection of the Westerly right- of-way line of said Jaeger Drive and the Centerline of Osprey Drive, as shown on the said plat of TROPIC PALMS PLAT NO. 17 thence north 02o49'35" West, along said westerly right-of-way line of Jaeger Drive, 460.07 feet; thence continuing along said westerly right-of-way line, northwesterly along the arc of a tangent curve, concave to the southwest, having a radius of 234.94 feet, a delta of 25°21'07'', an arc distance of 103.96 feet to a point of cusp; thence southeasterly along the arc of a tangent curve, concave to the northeast, having a radius of 85.00 feet, a delta of 61°49'18'', an arc distance of 91.71 feet; thence tangent to said curve, east, 35.27 feet to a point on the southerly right-of-way line of Quail Road, as shown on the said plat of TROPIC PALMS PLAT NO. 17 thence along said right-of-way line and along the easterly right-of-way line of Jaeger Drive, southwesterly along the arc of a tangent curve, concave to the southeast, having a radius of 25.00 feet, a delta of 97o22'38'', an arc distance of 42.49 feet to a point of reverse curvature; thence continuing along said right-of-way line, southeasterly along the arc of a tangent curve concave to the southwest · having a radius of 294.94 feet, a delta of 04o33'03'', an arc distance of 23.43 feet; thence tangent to said curve, south 02o49'35'' east, 463.03 feet to a point on the aforementioned centerline of Osprey Drive; thence West along said centerline, 60.07 feet to the point of beginning; containing 0.7260 acres, more or less. Section 2. That this abandonment is subject to the following conditions as a prerequisite to its effectiveness: (a) Along the east side of the property allow for a continuous 30' right-of-way transitioning to zero at the N.E. corner of Town and Country Development (b) Provide a right-of-way at the N.E. corner to allow for a "T" intersection at S.W. 4th Avenue and Quail Road. (c) Provide the necessary right-of-way to adjust the align- ment of Egret Circle so that it is continuous with Quail Road. (d) The paving improvements for Quail Road are to terminate 100' west of S.W. 4th Avenue in a "T" intersection. This means any driveways from the subject development will have to connect to Quail Road west of this point and no drive- way connections would be allowed to S.W. 4th Avenue.
