A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY
BEACH, FLORIDA, UNDER THE "LOCAL GOVERNMENT COMPREHENSIVE
PLANNING ACT OF 1975" ADOPTING PURSUANT TO SAID ACT
PUBLIC PARTICIPATION PROCEDURES AND PROCEDURES TO PROVIDE
REAL PROPERTY OWNERS WITH NOTICE OF ALL OFFICIAL ACTIONS
WHICH WILL REGULATE THE USE OF THEIR PROPERTY.
WHEREAS, the City Council is committed to encouraging and per-
mitting public participation in the comprehensive planning process; and,
WHEREAS, the Local Government Comprehensive Planning Act of
1975 (hereinafter the "Planning Act") directs the local governing body
to adopt procedures designed to provide effective public participation
in the comprehensive planning process and to provide real property
owners with notice of all official action which regulate the use of
their property; and,
WHEREAS, the City Council has received the recommendation of
the Planning and Zoning Board of the City of Delray Beach acting as the
local planning agency under the "Planning Act"; and,
WHEREAS, the City Council wishes to acknowledge the fine efforts
of the Planning and Zoning Board and the extensive procedures for public
participation and to provide real property owners with notice of offi-
cial actions, which the Planning and ZOning Board followed during its
deliberations concerning the Comprehensive Plan and alternatives,
NOW, THEREFORE, the City Council of the City of Delray Beach
hereby adopts the procedures set forth below for effective public parti-
cipation and for providing real property owners with notice of all
official actions which will regulate the use of their property:
1. Dissemination of Comprehensive Plan proposals and alternatives.
a) Workshop Session - The City Council will hold a workshop
session on the Comprehensive Plan and alternatives on
August 20, 1979 at 7:00 P.M. in City Council Chambers,
in the Delray Beach City Hall, located at 100 N.W. 1st
Avenue, Delray Beach, Florida. During the workshop
session, the City's planning consultant will provide a
brief review and analysis of the Comprehensive Plan after
which the City Council will hear and consider public
comment in regard to the plan and alternatives. There
will also be an opportunity for discussions between the
public, the planning staff, the planning consultant and
members of the City Council.
b) Public Hearings - The City Council will hold two public
hearings on the proposed Comprehensive Plan and alter-
natives, the first of which will be held September 10,
1979, and the second of which will be held September 24,
1979, both of which shall at 7:00 P.M. in the City Council
Chambers at the City Hall, located at 100 N.W. 1st Avenue,
Delray Beach, Florida. Although the public hearings are
in a somewhat more formal atmosphere than the workshop
meeting will be, during the public hearings the City
Council will also hear and consider any public comment
with regard to the proposed and alternatives. There will
be an opportunity for a full discussion and exchange of
views between the members of the public, the planning
staff, the planning consultant and the members of the City
Council. It is intended that at the conclusion of the
second public hearing on September 24, 1979, that the City
Council will adopt a Comprehensive Plan under the pro-
visions of the "Planning Act".
c) A copy of the proposed plan and alternatives shall be
available for examination by the public between the hours
of 8:00 A.M. and 5:00 P.M. in the Planning Department in
the Delray Beach City Hall at 100 N.W. 1st Avenue, Delray
Beach, Florida. The City Administration is also hereby
directed to deliver two copies of the proposed plan and
alternatives to the Delray Beach Library to be available
for public review.
d) Notices Concerning the Proposed Plan and Alternatives -
Including the publication of this resolution in full, once
in the Delray Beach News Journal.
2. Opportunity for Written Comment.
a) The City Council will accept written comments at the
workshop meeting or either of the public hearings referred
to in Paragraph 1 above.
b) Written comments may also be submitted at any time prior
to the adoption of the plan to the Planning Director, Mr.
Dan Kotulla, Planning Department, 100 N.W. 1st Avenue,
Delray Beach, Florida. The Planning Director is instructed
to transmit such comments to the City Council at the
workshop meeting or either of the public hearings referred
in Paragraph 1 above, together with the comments, if any,
of the planning consultant or the Planning Director.
3. Public Hearings.
The public hearings to be held by City Council as referred
to in Paragraph 1 above will provide an opportunity for
open discussions.
4. Provisions for Open Discussions.
The workshop meeting and both public hearings of the City
Council shall be conducted on an open discussion basis
including and encouraging the opportunity for the public
to comment, ask questions and discuss with the planning
staff, the consultant, or the City Council members, any
aspect of the proposed plan and alternatives.
5. Communications Programs and Information Services.
a) Have available at the Delray Beach Public Library two
copies of the proposed plan and alternatives and at least
one copy available in the Planning Department of the City
Hall at 100 N.W. 1st Avenue, Delray Beach, Florida, 33444,
for public review.
b) Publish a full copy of this resolution one time in the
Delray Beach News Journal to inform the public of the
availability of the proposed plan and alternatives to-
gether with the information contained in this resolution
as to the availability of the planning staff and the
planning consultant of the City, at the workshop session,
and public hearings for the public to ask questions, to
discuss, and hear presentations concerning the proposed
plan and alternatives.
c) The Planning Department shall make a staff member avail-
able to any civic group or organization that requests a
presentation in regard to the proposed plan and alter-
natives until the adoption of the plan by the City Council.

6. Consideration and Response to Public Comments.
a) Solicit questions and comments from the public in attend-
ance at the workshop and the public hearings referred to
in Paragraph 1 of this resolution, at which times the
planning staff and/or consultant will be available for an
explanation or response to the questions or comments of
the public and the City Council will consider the com-
ments.
b) Review notes, written comments and minutes from the work-
shop meeting and public hearings to consider and follow up
on pertinent public comments.
7. Providing Real Property Owners With Notice of all Official
Action Which Will Regulate the Use of Their Property.
a) Provide for newspaper publications of notice of the public
hearings referred to in Paragraph 1 of this resolution.
b) Publish one time in the Delray Beach News Journal a full
copy of this resolution.
c) The planning staff will be available during the hours of
8:00 A.M. to 5:00 P.M. to answer questions of real prop-
erty owners and the public with regard to the intended
time table for official actions to be taken in regard to
the proposed Comprehensive Plan and alternatives.
This resolution shall become effective upon its adoption by the
City Council of the City of Delray Beach.
