A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY
BEACH, FLORIDA, AWARDING A CONTRACT FOR WATER AND SEWER
IMPROVEMENTS.
WHEREAS, City Council has determined that it would be in the
best interest of the City to expand the City's water treatment plant and
to add a new south pumping station; and,
WHEREAS, City Council has determined that in order to make
these improvements a Water and Sewer Revenue Bond Issue would be
necessary to finance said improvements; and,
WHEREAS, bids for the construction of said improvements were
opened on the 13th of July, 1979, and tabulated by Russell and Axon,
Engineers for the City; and,
WHEREAS, it is the recommendation of Russell and Axon that the
base bid for both parts of said construction by Intercounty Construction
Corporation of Florida be conditionally accepted by the City; and,
WHEREAS, it is the recommendation of the City Manager that the
City Council award a contract for these improvements; and,
WHEREAS, an analysis of the bids received is as follows:

WHEREAS, Intercounty Construction Corporation's bid was $18,900.00
lower than the next lowest base bid combination with computer alternative;
and,
WHEREAS, in consideration of the mutual covenants set forth
herein, Inter¢ounty Construction Corporation of Florida, through a
letter dated August 13, 1979, from Leslie W. Koehler, Jr., Vice-
President, has agreed to maintain their base bid prices and keep their
base bid open through November 1, 1979, and the City agrees not to rebid
this project through November 1, 1979; and,
WHEREAS, in reliance upon the above-stated conditions, it is
the recommendation of the City Manager, and the opinion of City Council,
that this contract for the construction of both Part A, Water Treatment
Plant Expansion and Part B, New South Pumping Station be awarded, con-
ditionally, to the lowest and best bidder, Intercounty Construction
Corporation of Florida, subject to the City's final acceptance of said
bid and execution of the contract which, if it occurs at all, shall take
place not later than November 1, 1979,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That in reliance~upon the agreement of Intercounty
Construction Corporation of Florida to maintain its base bid prices and
hold its base bid open through November 1, 1979, and the agreement of
the City of Delray Beach to not rebid this project through said date of
November 1, 1979, this contract for the construction of Part A, Water
Treatment Plant Expansion and Part B, New South Pumping Station is
hereby awarded, conditionally, to the lowest base bidder, Intercounty
Construction Corporation of Florida, in the amount of $4,417,000.00,
subject to the City's final acceptance of said bid and execution of the
contract which, if it occurs at all, shall take place not later than
November 1, 1979.
Section 2. That the contract for the construction of the
improvements described by this Resolution No. 62-79 shall be executed by
the proper City officials and shall take place, if at all, not later
than November 1, 1979. The City's final acceptance shall be evidenced
by its signing of the contract, in accordance with the conditions set

forth in this Resolution and as per Paragraph 9, Section IFB (Informa-
tion for Bidders), of the Project Manual for the Water Works Improve-
ments, Parts A and B, Project No. 637-591-22, dated February, 1979.
PASSED AND ADOPTED in regular session on this the 13th day of
August, 1979.
