Res 68-79 RESOLUTION NO. 68-79 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, VACATING AND ABANDONING A 20 FOOT UTILITY EASEMENT LYING IN TRACT 2, TROPIC TOWERS, AS RECORDED IN PLAT BOOK 29, PAGE 9, PUBLIC RECORDS OF PALM BEACH COUNTY, FLORIDA, LOCATED IN SECTION 33, TOWNSHIP 46 SOUTH, RANGE 43 EAST. WHEREAS, Pelican Harbor Associates is the owner of Tract 2, Tropic Towers, as recorded in Plat Book 29, Page 9, Public Records of Palm Beach County, Florida; and, WHEREAS, Cary Cook, as a partner of Pelican Harbor Associates, has petitioned the City of Delray Beach for abandonment of a 20 foot utility easement in Tract 2, Tropic Towers; and, WHEREAS, the City Council of the City of Delray Beach, Florida, deems it to be in the best interests of the City of Delray Beach to Vacate and abandon said 20 foot utility easement, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That pursuant to Chapter 166, Florida Statutes, it is hereby determined to vacate and abandon the following described real property: A strip of land 20 feet in width in TRACT 2, TROPIC TOWERS, according to the plat thereof recorded in Plat Book 29, Page 9 of the Public records of Palm Beach County, Florida, lying 10.00 feet on either side of the following described centerline: Commence at the point of intersection of the westerly boundary of said TRACT 2 said westerly boundary being the arc of a curve concave to the West having a radius of 550.00 feet, with the intersection of a line that is 311.00 feet North of and parallel to the southern boundary of said TRACT 2; thence run East on a line that is 311.00 feet North of and parallel to the south boundary of said TRACT 2 to the point of intersection with a line that is 283.00 feet WEST of and parallel to the easterly boundary of said TRACT 2; Thence run North 10°06'52'' East 415.00 feet along the line that is 283.00 feet West of and parallel to the East boundary of said TRACT 2 to the point of termination of the above-described centerline.
