52-91 ORDINANCE NO. 52-91 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DELRAY BEACH, FLORIDA, AMENDING CHAPTER 52, "WATER", SECTION 52.83(A), "BACKFLOW PREVENTION DEVICES; WHEN REQUIRED; SPECIFICATIONS", OF THE CODE OF ORDINANCES OF THE CITY OF DELRAY BEACH, FLORIDA, CORRECTING A REFERENCE TO A STATE RULE; PROVIDING A GENERAL REPEALER CLAUSE; PROVIDING A SAVING CLAUSE; PROVIDING AN EFFECTIVE DATE. WHEREAS, Chapter 52, "Water", Section 52.83(A), "Backflow Prevention Devices; When Required; Specifications", of the Code of Ordinances of the City of Delray Beach, Florida, incorrectly references a state regulation; and, WHEREAS, the City Commission of the City of Delray Beach, Florida, in order to rectify this error in the Code of Ordinances, seeks to correct the reference, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That Chapter 52, "Water", Section 52.83, "Backflow Prevention Devices; When Required; Specifications", subsection 52.83(A), be, and the same is hereby amended to read as follows: 52.83 Backflow Prevention Devices; When Required; Specifications (A) No water service connection to any premises shall be installed or maintained by the water purveyor unless the water supply is protected as required by state law and regulation ~D~R~/~~/~/~7~ (Fla. Admin. Code Rule 17-555) and this subchapter. Service of water to any premises shall be discontinued by the water purveyor if a backflow prevention device required by the subchapter if not installed, tested, and maintained, or if it is found that a backflow prevention device has been removed, bypassed or if an unprotected cross connection exists on the premises. Service will not be restored until such conditions or defects are corrected. Section 2. That should any section or provision of this ordinance or any portion thereof, any paragraph, sentence, or word be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or part thereof other than the part declared to be invalid. Section 3. That all ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed. Section 4. That this ordinance shall become effective ten (10) days from its passage on second and final reading.
