Res 88-79 RESOLUTION NO. 88-79 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, ACCEPTING ALL THE STREETS AND STORM DRAINS INSTALLED IN HIGH POINT, SECTION 7, ACCORDING TO PLAT NO. 2 OF HIGH POINT, SECTION 7, AS RECORDED IN PLAT BOOK 36, PAGES 64, 65 AND 66 OF THE PUBLIC RECORDS OF PALM BEACH COUNTY, FLORIDA, AS OPERATIONAL; PROVIDING THAT THIS RESOLUTION SHALL NOT DISCHARGE THE DEVELOPER FROM STRICT PERFORMANCE; PROVIDING FOR MAINTENANCE FOR AND REPAIRS BY DEVELOPER FOR ONE YEAR. WHEREAS, James D. Carlton, Inc., Consulting Engineers and Land Surveyors for the above mentioned project have certified all streets and storm drains as shown on their approved plans for said project have been completed and ready for use by the public; and, WHEREAS, the said streets and storm drains were inspected and approved by the City of Delray Beach Engineering Department, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DELRA¥ BEACH, FLORIDA, AS FOLLOWS: Section 1. That all streets, storm drains and related facili- ties have been installed in High Point, Section 7, according to Plat No. 2 of High Point, Section 7, as recorded in Plat Book 36, Pages 64, 65 and 66 of the Public Records'of Palm Beach County, Florida, and are hereby accepted by the City of Delray Beach as being operational, and shall become effective upon the date of passage and adoption of this resolution. Section 2. That nothing contained herein shall be construed as 'discharging the developer, High Point of Delray Builders, Inc., from strict performance of his remaining contractual obligations and duties, and that his bond (escrow account) shall remain in effect in all respects until released in accordance with his agreement with the City. Section 3. That the developer and/or his representative shall assume full responsibility for all streets and storm drains installed in the afore-mentioned locations to be operational and substantially in accordance with the Contract and City Specifications for a period of twelve (12) months after date of acceptance by the City of Delray Beach.
