Res 94-79 RESOLUTION NO. 94-79 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AUTHORIZING PURSUanT TO THE CHARTER OF THE CITY OF DELRAY BEACH THE EXCHANGE OF REAL PROPERTY OWNED BY THE CITY OF DELRAY BEACH LOCATED IN SECTION 16, TOWNSHIP 46 SOUTH, RANGE 43 EAST. %~EREAS, the City of Delray Beach, Florida, is the owner of a portion of Lots 17 and 18, Block 1, Ocean Park, Delray Beach, Palm Beach County, Florida, according to the plat thereof, recorded in Plat Book 5 at Page 15 of the Public Records of Palm Beach County, Florida, being more particularly described as follows: The South 51.0 feet of the East Half (E½) of said Lot 18; and the South 51.0 feet of said Lot 17.; and, WHEREAS, Arvilla Corp. is the owner of a portion of Lots 18 and 19, Block 1, Ocean Park, Delray Beach, Palm Beach County, Florida, according to the plat thereof, recorded in Plat Book 5 at Page 15 of the Public Records of Palm Beach County, Florida, being more particularly described as follows: The North 39.0 feet of the East 20.0 feet of said Lot 19; and the North 39.0 feet of the West Half (W½) of said Lot 18; less and not including the North 5.0 feet of said parcels for the right-of-way of Atlantic Avenue.; and, WHEREAS, City Council has previously discussed and is of the opinion that it would be in the best interest of the City to exchange the above referenced real property owned by the City for the above referenced real property owned by the Arvilla Corp. upon the terms and conditions set forth in this resolution, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That the City Council of the City of Delray Beach does hereby authorize the exchange by standard form general warranty deed of the above-described real property located in the City of Delray Beach. Section 2. That the exchange of the above-described property shall be conditioned upon the following: (1) That Arvilla Corp., shall pay to the City of Delray Beach $150.00 to held defray the cost of relocating the sprinkler system and landscaping. (2) That each party shall pay for the title insurance and documentary stamps on the property being con- veyed to the other. (3) That title to the real property which the City is to receive pursuant to this exchange shall be subject to and contingent upon the approval of the City Attorney's office.
