A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY
BEACH, FLORIDA, CANVASSING THE RESULTS OF A BOND ELECTION
HELD IN THE CITY OF DELRAY BEACH, FLORIDA, ON DECEMBER
11, 1979, AND DECLARING AND CERTIFYING THE RESULTS THEREOF.
~EREAS, the City Council of the City of Delray Beach, Florida,
by a resolution duly and regularly adopted at its meeting held on the 22nd
day of October, 1979, did call an election to be held on the llth day of
December, 1979, for the purpose of submitting to the qualified electors
residing within the City, for their approval or disapproval of the ques-
tions of whether the City should issue General Obligations Bonds in the
aggregate principal amount of not exceeding $1,390,000 consisting of four
separate issues of bonds, bearing interest at a rate or rates not to
exceed the legal rate fixed by law; and said resolution having further
provided and directed that notice of said election be given by publication
in accordance with law; and,
WHEREAS, due and regular notice of said bond election has been
published in the Delray Beach News Journal and the Palm Beach Post Times,
both being newspapers of general circulation in the City of Delray Beach,
Florida, and said publications having been made twice, once in the fifth
week and once in the third week prior to the week in which the referendum
is to be held, to-wit: December 11, 1979; and,
¥~{EREAS, pursuant to the aforesaid resolution calling said elec-
tion and in accordance with law, the questions in said resolution stated
were submitted to the qualified electors residing in said City, for parti-
cipation in the election on the date specified in said resolution, to-wit:
December 11, 1979; and,
WHEREAS, it appears that the list of qualified electors who voted
at such election has been returned to this City Council by the Inspectors
and Clerks together with the returns hereinafter mentioned; and,
WHEREAS, it appears that said election has been duly and properly
held in accordance with law and that the votes cast thereat have been
returned, delivered and canvassed, and that the returns of said election
have been delivered to this City Council for the purpose of canvassing
said election returns and determining and certifying the results thereof;
and,
~EREAS, it appears from the official returns of said election so
delivered to this City Council and so canvassed by this City Council as
aforesaid that the total numbers of votes cast in said election by such
qualified electors, as above described, residing in said City approved the
issuance of Proposal Nos. 1, 2, 3 and 4.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That the City Council at this meeting duly and
regularly held, have duly and regularly canvassed according to law the
official returns of said election and hereby determines, finds, declares
and certifies the results of such election, as follows:
Proposal No. 1 - $600,000 Bonds for the payment of all or a por-
tion of the costs of the renovation and expansion of the existing City
Hall Building:
(a) The total number of votes cast in such election by said
qualified electors residing in said City in favor of the issuance of the
bonds described in Proposal No. 1 was 1681.
(b) The total number of votes cast in such election by said
qualified electors residing in said City against the issuance of the bonds
described in Proposal No. 1 was 767.
(c) A majority of the votes cast in such election by such
qualified electors residing in said City approved of the issuance of the
bonds submitted at such election under Proposal No. 1.
Proposal No. 2 - $430,000 Bonds for the payment of all or a por-
tion of the costs of construction of a fire station building and for the
purchase of fire equipment and rescue vehicles:
(a) The total number of votes cast in such election by said
qualified electors residing in said City in favor of the issuance of the
bonds described in Proposal No. 2 was 1958.
(b) The total number of votes cast in such election by said
qualified electors residing in said City against the issuance of the bonds
described in Proposal No. 2 was 545.
(c) A majority of the votes cast in such election by said
qualified electors residing in said City approved of the issuance of the
bonds submitted in said election under Proposal No. 2.
Proposal No. 3 - $45,000 Bonds for the payment of all or a por-
tion of the costs of renovation and expansion of the existing police
station:
(a) The total number of votes cast in such election by said
qualified electors ~esiding in said City in favor of the issuance of the
bonds described in Proposal No. 3 was 1733.
(b) The total~number of votes cast in such election by said
qualified electors residing in said City against the issuance of the bonds
described in Proposal No. 3 was 747.
(c) A majority of the votes cast in such election by said
qualified electors residing in said City approved of the issuance of the
bonds submitted at such election under Proposal No. 3.
Proposal No. 4 -$315,000 Bonds for the payment of all or a por-
tion of the costs of bicycle paths and for improvements to Miller Park:
(a) The total number of votes cast in such election by said
qualified electors residing in said City in favor of the issuance of the
bonds described in Proposal No. 4 was 1646.
(b) The total number of votes cast in such election by said
qualified electors residing in said City against the issuance of the bonds
described in Proposal No. 4 was 914.
(c) A majority of the votes cast in such election by said
qualified electors residing in said City approved of the issuance of the
bonds submitted in said election under Proposal No. 4.
Section 2. That said election was in all respects conducted in
accordance with law, and that all steps in connection with and preceding
such election have been duly, regularly and lawfully taken and had, and
that all provisions of the Statutes and Constitution of the State of
Florida have been duly complied with.
Section 3. That the issues of bonds approved at said election as
provided above, if any, may be issued at such time or times and with such
other details and conditions as shall be hereafter determined by the City
Council.

Section 4. That said returns shall be entered and recorded in
the minutes of the City Council; and this resolution, determination,
finding, declaration and certificate shall be recorded in the minutes of
said City Council.
Section 5. That this resolution shall take effect immediately.
PASSED AND ADOPTED in special session on this the 13th day of
December, 1979.
