A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
DELRAY BEACH, FLORIDA, REQUESTING PERMISSION
FROM THE BOARD OF COUNTY COMMISSIONERS, PURSUANT
TO FLORIDA STATUTES 171o062(2), TO REZONE LAND
TO BE ANNEXED TO THE CITY OF DELRAY BEACH FROM
THE COUNTY ZONING CLASSIFICATION AG (AGRICULTURAL)
TO THE CITY'S ZONING CLASSIFICATION R-1AAA
(SINGLE FAMILY DWELLING) DISTRICT.
WHEREAS, the City of Delray Beach has received a request for annexation
from Paul Weiner, Partner and Jeffrey M. Rosenberg, Partner, Pebb Enter-
prises, a Florida Partnership, the owners of the following described propertyi:
Southwest Quarter'of Northeast Quarter of Northeast Quarter
South of Germantown Road; Northwest Quarter of Southeast
Quarter of Northeast Quarter; Southwest Quarter of North-
east Quarter, Section 25, Township 46 South, Range 42 East.
EXCEPTING a strip'of land 40 feet in width lying on each
side of center line of any County Road and rights-of-way
of the Lake Worth Drainage District as laid out on
October 15, 1945, as in Deed Book 732, Page 377, Palm Beach
County,F~oridg, Public Records.
ALSO, ~ND THE, CITY REQUESTS PERMISSION TO ANNEX AND REZONE;
All of that part of Germantown Road'lying north of the above
described~parcel of lando
The above described parcel contains a 28.11 acre parcel of land; and,
WHEREAS, the City Council at March 28, 1978 regular meeting con-
sidered this annexation request and upon the recommendations of the
Planning and Zoning Board at the meeting held on £~arch 2i, i9'/8, feels that
the proper zoning for this parcel of land would be the City's Zoning Classi-
fication R-1AAA (Single Family Dwelling) District; and,
WHEREAS, Chapter 171.062(2) Florida Statutes, requires that when a
Municipality desires to annex property at a zoning classification, which
would permit higher density than is currently in effect under County regu-
lations, that the Municipality request and receive permission from the Board
· of County Commissioners for such a change,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That 'the City Council hereby requests permission from the
Board of County Commissioners of Palm Beach County to rezone, when annexed,
the property described above from AG (Agricultural) to R-1AAA (Single Family
Dwelling) District which will result in an increase in the density allowed
in such land.
Section 2. That a certified copy of this resolution is being sent to
each member of the Board of County Commissioners, the County Administrator
and the Director of Planning, Zoning and Building.
PASSED AND ADOPTED in regular session on this the 8th day of
