Res 39-78 RESOLUTION NO. 39-78 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, REQUESTING PERMISSION FROM THE BOARD OF COUNTY COMMISSIONERS, PURSUANT TO FLORIDA STATUTES 171.062, TO REZONE LAND TO BE ANNEXED TO THE CITY OF DELRAY BEACH FROM THE COUNTY ZONING CLASSIFICATIONS RS (RESIDENTIAL SINGLE FAMILY) AND CG (GENERAL COMMERCIAL) TO THE CITY'S ZONING CLASSIFICATION SC (SPECIALIZED COMMERCIAL) DISTRICT AND R-1AA (SINGLE FAMILY RESIDENTIAL) DISTRICT. WHEREAS, the City of Delray Beach has received a request for annexa- tion from Salvatore Virga, President, H.D.V. Construction Corp., the owner of the following described property: From: RS (Residential Single Family)~ To: SC (Specialized Commercial) District Lots 21 through 25, inclusive, Block 27 and Lots 28 through 32, inclusive, Block 28, Del-Raton Park Subdivision, as recorded in Plat Book 14, Pages 9 and 10 of the Public Records of Palm Beach County, Florida, Sections 28 and 29, Township 46 South, Range 43 East. From: CG (General Commercial) To: SC (Specialized Commercial) District Lots 6 through 20, inclusive, Block 27; Lots 1 through 5, inclusive, Block 28 and Lots 33 through 42, inclusive, Block 28, Del-Raton Park Subdivision, as recorded in Plat Book 14, Pages 9 and 10 of the Public Records of Palm Beach County, Florida, Sections 28 and 29, Township 46 South, Range 43 East. From: CG (General Commercial) To: R-1AA (Single Family Dwelling) District Lots 35 and 36, Block 27, Del-Raton Park Subdivision, as recorded in Plat Book 14, Pages 9 and 10 of the Public Records of Palm Beach County, Florida, Sections 28 and 29, Township 46 South, Range 43 East. ALSO, AND THE CITY REQUESTS PERMISSION TO ANNEX AND REZONE: The West one-half (W%) of Frederick Boulevard, which abuts the easterly boundary of the above described parcel. The above described parcel contains 3.416 acres more or less; and, WHEREAS, the City Council at the November 7, 1977, workshop meeting considered this annexation ~request and upon the recommendations of the Planning and Zoning Board at the meeting held on October 18, 1977, feels that the proper zoning for this parcel of land would be the City's Zoning Classification SC (Specialized Commercial) District; and, WHEREAS, Chapter 171.062 Florida Statutes, requires that when a Municipality desires to annex property at a zoning classification dif- ferent than the zoning classification then applying to the property in the County, the Municipality must request permission from the Board of County Commissioners tO change the zoning claSsification, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That the City Council hereby requests permission from the Board of County Commissioners of Palm Beach County to rezone, when annexed, the property described above from RS (Residential Single Family) and CG (General Commercial) to SC (Specialized Commercial) District and R-1AA (Single Family Dwelling) District. Section 2. That a certified copy of this resolution is being sent to each member of the Board of County Commissioners, the County Administrator and the Director of Planning, Zoning and Building.
