Res 40-78 RESOLUTION N0.40-78 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, ACCEPTING THE 12" D.I.P. WATER MAIN EX- TENSION, BARWICK ROAD LOOP, EDA NO. 04-51-26797 AND RE- LATED FACILITIES LOCATED AT A POINT OF BEGINNING AT WEST ATLANTIC AVENUE, THENCE IN A NORTHERLY DIRECTION ON BARWICK ROAD TO THE INTERSECTION OF LAKE IDA ROAD AND BARWICK ROAD, THENCE IN AN EASTERLY DIRECTION FOR A DISTANCE OF 2,180' ON LAKE IDA ROAD TO CHATELAINE BOULEVARD, CITY OF DELRAY BEACH, FLORIDA, AS OPERATIONAL AND SETTING THE INITIAL SCHEDULE OF RATES, FEES AND OTHER RELATED CHARGES TO BE IMPOSED FOR THE SERVICES AND FACILITIES FURNISHED BY THE SAID UTILITIES. WHEREAS, Russell an'd Axon, Consulting Engineers for the above project, has certified as operational all-water utilities and related facilities as shown on their plans for said project and previously approved by the City of Delray Beach; and WHEREAS, the said utilities were inspected and approved as operational by the Director of Public Utilities Department'of the City of Delray Beach, Florida, and WHEREAS, it is deemed to be in the best interest of the affected pro- perties that the initial schedule of rates, fees and other related charges be imposed for the services and facilities furnished by the .water system, as set'forth and contained'per Part II, Chapter 27, Water and Sanitary sewerage of the Code of Ordinances of the City shall become effective upon this date of passage and adoption of this resolution. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That the 12" D.I.P. water main extension, Barwick Road Loop EDA No. 04-51-26797 and related facilities in the afore-mentioned location, hereby be accepted by the City of Delray Beach as being operational and the initial schedule of rates, fees and other charges previously established, and applicable thereto, shall become effective upon the date of passage and adoption of this resolution. Section 2. That nothing herein contained shall be construed as dis- charging the contractor from strict performance of his remaining contractual duties and that his bond (escrow account) remain in effect in all respects until released in accordance with his agreement.
