RESOLUTION NO. 46-78 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, REQUESTING PERMISSION FROM THE BOARD OF COUNTY COMMISSIONERS, PURSUANT TO FLORIDA STATUTES 171.062, TO REZONE LAND TO BE ANNEXED TO THE CITY OF DELRAY BEACH FROM THE COUNTY ZONING CLASSIFICATION AG (AGRICULTURAL) TO THE CITY'S ZONING CLASSIFICATION RM-10 (MULTIPLE FAMILY DWELLING) DISTRICT. WHEREAS, the City of Delray Beach has received a request for annexa- tion from Rhodes B. Baker and Jessie H. Baker, his wife, the owners of the following described property: Commencing at the intersection of the West right of ~ay of the Seaboard Airline Railway with the East-West Quarter Section line of Section 30, Township 46 South, Range 43 East, Palm Beach County, Florida, and run therefrom S 0© 27' 17" E along said West right of way line 476.28 feet; thence run S 89o13' 16" W on a line parallel to said quarter section line 1747.62 feet to the Point of Beginning, thence continue with a bearing of S 89o13' 16" W 281.97 feet to a point; thence run N 0o27' 17" W on a line parallel to said West right of way line 476.28 feet to a point on said quarter section line, thence run N 0o57'54'' W 910.00 feet to a point on the South right of way line of Germantown Road as now laid out and in use, thence run N 69°08'51'' E along said South right of way line 300.00 feet, thence run S 0o57'54'' E 1013.27 feet to a point on the said quarter section line, thence run S 0°27'17'' E 476.28 feet more or less to the Point of Beginning. The subject property is in Section 30-46-43, and is located at the southeast corner of the intersection of Germantown Road and S.W. 22nd Avenue. The above described Parcel contains 9.31 acres more or less; and, WHEREAS, the City Council at the May 8, 1978, regular meeting con- "sidered this annexation request and upon the recommendations of the Planning and Zoning Board at the meeting held on April 25, 1978, feels that the proper 'zoning for this parcel of land would be the City's Zoning Classification RM-10 (Multiple Family Dwelling) District; and, WHEREAS, Chapter 171.062 Florida Statutes, requires that when a ,.Municipality desires to annex property at a zoning classification, which would permit higher density that is currently in effect under County regula- tions, that the Municipality request and receive permission from the Board of County Commissioners for such a change, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That the City Council hereby requests permission from the Board of County Commissioners of Palm Beach County to rezone, when annexed, the property described above from AG (Agricultural) to RM-10 (Mul- tiple Family Dwelling) District which will result in an increase in the . density allowed in such land. Section 2. That a certified copy of this resolution is being sent to each member of the Board of County Commissioners, the County Administrator and the Director of Planning, Zoning and Building.
