A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY
BEACH, FLORIDA, ACCEPTING ALL THE SANITARY SEWERS,
WATER UTILITIES AND STORM DRAINS IN COUNTRY MANORS,
SECTION 4 SUBDIVISION, CITY OF DELRAY BEACH, FLORIDA,
AS OPERATIONAL AND SETTING THE INITIAL SCHEDULE OF
RATES, FEES AND OTHER RELATED CHARGES TO BE IMPOSED
FOR THE SERVICE AND FACILITIES FURNISHED BY SAID SANI-
TARY SEWERS AND WATER UTILITIES.
WHEREAS, O'Brien, Suiter and O'Brien, Inc., Engineers and Land Sur-
veyors for the above project have certified as operational all the sanitary
sewers, water mains and storm drainage facilities as shown on their plans
for said project and previously approved by the City Engineer.
WHEREAS, the sanitary sewers and water utilities were inspected and
approved as operational by the Public Utilities Department of the City of
Delray Beach, and
WHEREAS, it is deemed to be in the best interest of the affected
properties, that the initial schedule of rates, fees, and other related
charges be imposed for the services and facilities furnished by the water
and sewer systems, as set forth and contained per Part II, Chapter 27,
Water and Sanitary Sewerage of the Code of Ordinances of the City shall be-
come effective upon the date of passage and adoption of this resolution.
WHEREAS, the said storm drains were inspected and approved by the
City of Delray Beach Engineering Department
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That all (1) sanitary sewers and related facilities and
(2) water mains and related facilities in the afore-mentioned locations,
hereby be accepted by the City of Delray Beach as being operational and
the initial schedule of rates, fees and other charges previously established
and applicable thereto, shall become effective upon the date of passage of
this resolution.
Section 2. That all storm drains and related facilities installed in
the above-mentioned locations hereby be accepted by the City of Delray
Beach as being operational and shall become effective upon the date of
passage and adoption of this resolution.
Section 3 That nothing herein contained shall be construed as dis-
charging the developer from strict performance of his rema~ning contractual
duties.
Section 4. That the developer and/or his representative must assume
full responsibility for all sanitary sewers, water utilities, storm drains
and related facilities installed in the afore-mentioned locations to be
operational and substantially in accordance with the Contract and City
Specifications for a period of twelve (12) months after date of acceptance
by the City of Delray Beach.
