A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY
BEACH FLORIDA, VACATING AND ABANDONING THE EAST 110.0
FEET OF AN ALLEY 20 FEET IN WIDTH LOCATED ADJACENT TO
LOTS 1 - 2 - 3 AND 4, BLOCK 1 OF THE SUBDIVISION KNOWN
AS DELRAY BEACH HEIGHTS EXTENSION A; PLAT BOOK 26, PAGE
83, AS RECORDED IN THE PUBLIC RECORDS OF PALM BEACH COUNTY,
FLORIDA, RESERVING HOWEVER A 10-FOOT EASEMENT, FIVE (5) FEET
ON EITHER SIDE OF THE CENTERLINE OF THE ALLEY BEING ABANDONED
FOR UTILITY PURPOSES.
WHEREAS, the City of Delray Beach, Florida, in conjunction with
the City's raw water supply system, has cause to vacate and abandon the east
110.0 feet of an alley 20 feet in width located adjacent to Lots 1 - 2 - 3
and 4, Block 1 of the Subdivision known as Delray Beach Heights Extension "A";I
as recorded in Plat Book 26, Page 83 of the Public Records of Palm Beach ~
County, Florida, reserving however a 10-foot easement, five feet on either sile
of the centerline of the alley being abandoned for utility purposes, and
WHEREAS, the City of Delray Beach Engineering Department and the
Planning and Zoning Staff recommends that said 110.0 feet of an alley 20 feet
in width be abandoned reserving however a 10-foot easement, five feet on
either side of the centerline of the alley being abandoned for utility
purposes,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DELRA¥ BEACH, FLORIDA, AS FOLLOWS:
Section 1. That pursuant to Chapter 166 Florida Statutes, it is
hereby determined to vacate and abandon the following described portion of
a 20-foot alley:
The east 110.0 feet of an alley 20 feet in width
located adjacent to Lots 1 - 2 - 3 and 4, Block 1
of the Subdivision known as Delray Beach Heights Extension
"A", Plat Book 26, page 83, of the Public Records of Palm
Beach County, Florida, reserving however a 10-foot ease-
ment five feet on either side of the centerline of the
alley being abandoned for utility purposes.
PASSED AND ADOPTED in regular session on this the 14th
day of Auqust , 1978.
