A RESOLUTION OF THE CITY COUNCIL OF T~IE CITY OF
DELRAY BEACH, FLORIDA, REQUESTING THE COUNTY TO
AMEND THEIR PROPOSED LAND USE PLAN TO REFLECT
THE CITY'S LAND USE PLAN DESIGNATION FOR SEVEN-
TEEN (17) UNINCORPORATED PARCELS OF LAND.
WHEREAS, there presently exists a large number of unincorporated
pockets of land located within the municipal limits of the City of Delray
Beach, Florida; and
W~.]REAS, the City of Delray Beach, Florida, has no legal juris-
diction or control over these unincorporated pockets of land; and
WHEREAS, in view of this lack of jurisdiction it is impossible
for the City of Delray Beach to adequately plan for the orderly develop-
ment of these unincorporated pockets of land which are located in the
City's reserve annexation area as delineated by the State Legislature
and incorporated in the City Charter; and
WHEREAS, the Local Government Comprehensive Planning Act requires
that each local government prepare and adopt a comprehensive plan; and
WHEREAS, the Local Government Comprehensive Planning Act requires
that intergovernmental coordination be a major objective of the compre-
hensive planning process, in order to ensure that each local government
considers the plans of other jurisdictions; and
WHEREAS, the City of Delray Beach is in the process of reviewing
its comprehensive plan for adoption under the 1975 Local Government
Comprehensive Planning Act; and
WHEREAS, in the process of its review, the City of Delray Beach
has determined that there exists thirty-seven (37) parcels of land which
represent discrepancies between the City and County's proposed Land Use
Plan; and
WHEREAS, as to twenty (20) of these discrepancies (shown in
yellow on the accompanying map) the City does intend to change its Land
Use Plan designation to the designation in the County Land Use Plan, at
the time when the City of Delray Beach adopts its Comprehensive Plan
under the Local Government Comprehensive Planning Act of 1975; and
WHEREAS, as to the other seventeen (17) discrepancies (shown in
red on the accompanying map) the City hereby requests the County's coopera~
tion in the implementation of the City's planning efforts in regard to
these unincorporated pockets, and that the County in furtherance thereof
change the designation of these parcels as shown on their Land Use Plan
to a designation compatible to that shown on the City's Land Use Plan,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That in order for the City of Delray Beach to ade-
quately plan for the orderly development of the unincorporated pockets
of land located within its reserve annexation area, the City Council of
the City of Delray Beach, Florida, hereby requests the County to amend
their proposed Land Use Plan to reflect the City's Land Use Plan designa-
tion for the seventeen (17) unincorporated parcels of land shown in red
on the accompanying map and described in the accompanying summary list.
