A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY
BEACH, FLORIDA, AUTHORIZING NEGOTIATION OF A CONTRACT
TO RAISE BEACH DRIVE FROM ANDREWS AVENUE TO A POINT
SOME 325 FEET WESTWARD, IN THE CITY OF DELRAY BEACH,
FLORIDA, TO ALLEVIATE FLOODING CONDITIONS DURING HIGH
TIDES; AND THIS RESOLUTION SUPERCEDES RESOLUTION NO.
15-78 AWARDING THE CONTRACT TO CARR SOIL AND SOD DRIVE-
WAYS, WHICH CONTRACTOR WAS UNABLE TO FULFILL SAID CON-
TRACT DUE TO SUBSEQUENT LACK OF QUALIFIED PERSONNEL.
WHEREAS, it is the recommendation of the City Manager that the Council
award a contract to raise Beach Drive from Andrews Avenue to a point some
325 feet westward, in the City of Delray Beach, to alleviate flooding condi-
tions during high tides, and
WHEREAS, two quotations were submitted as follows:
Hardrives, Inc. $12,500.00
Delray Beach, FL
H. L. Westberry $46,300.00
Deerfield Beach, FL
WHEREAS, the City Engineering Department certifies the above quotation
of $12,500.00 to be reasonable, consideration given to cost escalation
elements, and the City Manager recommends that the City of Delray Beach enter
into a contract with Hardrives, Inc., to raise Beach Drive from Andrews Ave-
nue to a point some 325 feet westward in the City of Delray Beach, in accor-
dance with specifications indicated on said Contractor's Proposal dated
7/10/78, and in accordance with City Specifications, which Contractor sub-
mitted the low quotation in the amount of $12,500.00; and
WHEREAS, it is the Council's opinion that the award of this contract
would be in the best interest of the City,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That said contract to raise Beach Drive from Andrews Ave-
nue to a point some 325 feet westward in this City, to alleviate flooding
conditions during high tides, in accordance with City Specifications and as
indicated on said Contractor's Proposal dated 7/10/78, be awarded to Har-
drives, Inc., Delray Beach, Florida, in the amount of $12,500.00.
Section 2. That this Resolution awarding the contract to Hardrives,
Inc., Delray Beach, supercede Resolution No. 15-78 awarding the contract to
Carr Soil and Sod Driveways, which Contractor was unable to fulfill his con-
tract due to subsequent lack of qualified personnel.
Section 3. That this improvement shall be funded with money trans-
ferred from the General Fund Contingency account, in the amount of $12,500.00
to the Streets, Alleys and Sidewalk account.
PASSED AND ADOPTED in regular session on this the 28th day
of Auqust , 1978.
