Res 103-78 RESOLUTION NO. 103-78 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, REQUESTING PERMISSION FROM THE BOARD OF COUNTY COMMISSIONERS, PURSUANT TO FLORIDA STATUTES 171.062, TO REZONE LAND TO BE ANNEXED TO THE CITY OF DELRAY BEACH FROM THE COUNTY ZONING CLASSIFICATIONS RS(RESIDENTIAL SINGLE FAMILY) AND CG(GENERAL COMMERCIAL) TO THE CITY'S ZONING CLASSIFICATION RM-10 (MULTIPLE FAMILY DWELLING) DISTRICT. WHEREAS, the City of Delray Beach has received a request for annexation from Salvatore Virga, President, H.D.V. Construction Corp., the owner of the following described property: From: RS (Residential Single Family) To : RM-10 (Multiple Family Dwelling) District Lots 21 through 25, inclusive, Block 27; Lots 28 through 32, inclusive, Block 28; Lots 18 through 29, inclusive and Lots 40 through 45, inclusive, Block 34, Del-Raton Park Subdivision, as recorded in Plat Book 14, Pages 9 and 10 of the Public Records of Palm Beach County, Florida, Sections 28 and 29, Township 46 South, Range 43 East. From: CG (General Commercial) To : RM-10 (Multiple Family Dwelling) District Lots 6 through 20, inclusive, Block 27; Lots 1 through 5, inclusive, Block 28 and Lots 33 through 42, inclusive, Block 28, Del-Raton Park Subdivision, as recorded in Plat Book 14, Pages 9 and 10 of the Public Records of Palm Beach County, Florida, Sections 28 and 29, Township 46 South, Range 43 East. ALSO, THE CITY REQUESTS PERMISSION TO ANNEX AND REZONE: The West one-half (W 1/2) of Florida Boulevard, which abuts the Easterly boundary of the subject parcel; and, That part of Frederick Boulevard, which is contained within the subject property. The above described parcels contain 4.586 acres more or less; and, WHEREAS, the City Council at the December 4, 1978, regular meeting considered this annexation request and upon the recommendations of the Planning and Zoning Board at the meeting held on November 28, 1978, feels that the proper zoning for these parcels of land would be the City's Zoning Classification RM-10 (Multiple Family Dwelling) District; and, WHEREAS, Chapter 171.062 Florida Statutes, requires that when a Municipality desires to annex property at a zoning classification different than the zoning classification then applying to the property in the County, the Municipality must request permission from the Board of County Commissioners to change the zoning classification, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That the City Council hereby requests permission from the Board of County Commissioners of Palm Beach County to rezone, when annexed, the property described above from RS(Residential Single Family) and CG(General Commercial) (County) to RM-10(Multiple Family Dwelling) District (City). Section 2. That a certified copy of th~s resolution is being sent to each member of' the Board of County Commissioners, the County Administrator and the Director of Planning, Zoning and Building.
