A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY
BEACH, FLORIDA, VACATING AND ABANDONING A 0.213 ACRE
TRACT OF LAND LOCATED WEST OF THE F.E.C. RAILROAD,
BETWEEN LINDELL BOULEVARD AND THE C-15 CANAL IN SEC-
TION 29, TOWNSHIP 46 SOUTH, RANGE 43 EAST.
WHEREAS, Karl Haselbauer, agent for Walter E. Helter and Co., South-
east, owner of Tract A4 Replat of a portion of Hidden VaIley, Section 2,
as recorded in Plat Book 27, Page 138 of the Public Records of Palm Beach
County, Florida, and Tract P Tropic Palms Plat No. 1, as recorded in Plat
Book 25, Pages 99-102 of the Public Records of Palm Beach County, Florida,
has petitioned the City of Delray Beach for abandonment of a 0.213 acre
tract of land located west of the F.E.C. Railroad, between Lindell Boulevard
and the C-15 Canal, in order to gain access to Tract A4 of the Hidden
Valley Subdivision and Tract P of Tropic Palms, Plat No. 1; and,
WHEREAS, the Engineering Department and the Planning and Zoning Board
of the City of Delray Beach recommends that said 0.213 acre tract of land
be abandoned,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That pursuant to Chapter 166 of the Florida Statutes, it
is hereby determined to vacate and abandon the following described tract
of land:
A parcel of land lying in the SE 1/4 of Section 29, Township
46 South, Range 43 East in the Town of Delray, Palm Beach County,
Florida, said parcel being more fully described as follows:
Beginning at the Southeast corner of Tract "P" of Tropic Palms,
Plat No. 1 on file in Plat Book 25, Page 101 of Palm Beach County
Records; thence S 8° 00' 30" W, an assumed bearing along the
Westerly right-of-way line of the Florida Eastcoast Railroad,
100.98 feet to a point of intersection with the southerly
boundary of the aforesaid Section 29; thence N 89° 59' 20" W,
along said southerly boundary, 90.88 feet to a point; thence
N 8" 00' 30" E, 130.14 feet to a point; thence from a tangent
bearing S 8" 00' 30" W, run southeast along a curve to the left,
having a radius of 25.36 feet, thru a central angle of 98" 00' 30",
an arc distance of 43.38 feet to the end of said curve; thence
due East, 61.71 feet to a point of intersection with the aforesaid
west right-of-way line of the Florida Eastcoast Railroad and the
Point of Beginning. Containing 0.213 Acres.
PASSED AND ADOPTED in regular session on this the llth day of
December, 1978.
