A RESOLUTION OF THE CiTY COUNCIL OF THE CITY
OF DELRAY BEACH, FLORIDA, SUPPORTING AN AMEND-
MENT TO CHAPTER 286 OF THE FLORIDA STATUTES
COMMONLY KNOWN AS ~E FLORIDA SUNSHINE LAW TO
EXEMPT CERTAIN GOVERNMENT ACTIVITY FROM THE
REQUIREMENTS OF SAID LAW, SPECIFICALLY THAT
THE FOLLOWING SUBJECT AREAS SHALL BE EXEMPT:
PERSONNEL MATTERS, LITIGATION, COLLECTIVE
BARGAINING, AND THE ACQUISITIONOF REAL PROPERTY.
WHEREAS, the State of Florida Legislature adopted Chapter 286
of the Florida Statutes, commonly referred to as the Sunshine Law; and,
WHEREAS, the purpose of the aforesaid Sunshine Law is to open
the activities of government to all citizens; and,
WHEREAS, it was thought that such opening of government
activity would be to the benefit of all citizens of the State of Florida;
and,
WHEREAS, the City Council of the City of Delray Beach supports
the principal of open and informed government; and,
WHEREAS, after several years of'experience with Chapter 286
'of the Florida Statutes, it has become apparent that public interest is
better served by hav. ing certain aspects of governmental activity exempt
from the requirements of the Florida Sunshine Law,
~NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That Chapter 286 of the Florida Statutes be
amended to create an exemption from the requirements of said act for
governmental activity in the areas of personnel matters, deliberations
concerning pending litigation, negotiation of collective bargaining
agreements, and the acquisition of real property.
Section 2. That copies of this resolution shall be sent to
Senators Harry A. Johnston II, Phi!!ip D. Lewis, Don C. Childers, George
Williamson, Jon Thomas, James Scott and Representatives Donald F. Hazelton
Reid Moore,Jr., William G. James, Edward Healey, John Considine and Tom
F. Lewis.
