Res 16-77 RESOLUTION NO. 16-77 A RESOLUTION OF THE CITY COUNCIL OF THE CI'I~ OF DELRAY BEACH, FLORIDA, TO T~ BUREAU OF BEACHES AND SI{ORES, DEPARTMENT OF NATURAL RESOURCES SETTING FORTH THE PUBLIC NEED, THE DESCRIPTION OF THE PROJECT PROPOSED AND THE LEGAL DESCRIPTION OF ~{E AREA FOR MAINTENANCE NOURISHMENT PROJECT FOR SUMMER OF 1977. WPIEREAS, the City of Delray Beach, ~lorida, has over the past four years suffered the loss of ocean front lands by erosion; and, ¥~TEKEAS, Chapter 74-102, Laws of Florida, Section 161.091, Florida Statutes, Rule 16B-23 provides that an application for Erosion Control Funds should be completed and submitted prior to construction; and, WHEREAS, Section 16B-23.05, Part C, Rules and Procedures for Disbursement of Erosion Control Trust Funds requires a resolution from the City setting forth the public need, the.description of the project proposed and the legal description of the area involved; and, WHEREAS, the Projec~ description is as follows: The City proposes to maintain a barrier beach for shoreline protection and recreation by a continual program of artificial nourishment. Maintenance nourishment is planned for the summer of 1977 during which approximately 500,000 cubic yards of sand will be taken from an offshore borrow area (Parcel 3) and placed on the shoreline of Delray Beach within the boundaries of Parcel 1 and Parcel - 2; and, WHEREAS, the legal description of the project proposed is as follows: Parcel No. 1 - North Fill Area A 100 foot wide parcel of submerged or emerged land in Sections 9, 10, 15, 16, 21, and 28, Township 46 South, Range 43 East, City of Delray Beach, Palm Beach County, Florida, bounded as follows: On the West by the Erosion Control Line as shown and recorded in Miscellaneous Plat Book 1, Pages l_and 2, of the Public Records of PalTM Beach County, Florida; on the North by a line intersecting said Erosion Control Line, said intersection having a "Y" coordinate, based on the Florida State Plane Coordinate System - East Zone, of 778,252, said intersecting line having a bearing of S 83°00'00"E; on the East bY a line 100 feet East of and parallel to said Erosion Control Line; and on the South by a line intersecting said Erosion Control Line, said intersection having a ,Y" coordinate, as based on said State Plane Coordinate System, of 771,506, said intersecting line having a bearing of S 83°00'00"E. Parcel No. 2 - South Fill Area A 180 foot wide parcel of submerged or emerged land in Sections 9, 10, 15, 16, 21, and 28, Township 46 South, Range 43 East, City of Delray Beach, Palm Beach County, Florida, bounded as follows: On the West by a line 80' West of and parallel to the Erosion Control Line as shown and recorded in miscellane- ous Plat Book 1, Pages 1 and 2, of the Public Records of Palm Beach County, Florida; on the North by a line intersecting said Erosion Control Line, said intersection having a "Y" coordinate, based on the Florida State Plane Coordinate System - East zone, of 767,925, said inter- secting line having a bearing of S 83°00'00"E; on the East by a line 100 feet East of and parallel to said Erosion Control Line; and on the South by a line inter- secting said Erosion Control Line, said intersection having a "Y" coordinate, as based on said state plane coordinate system, of 765,700, said intersecting line having a bearing of S 83°00'00"E. Parcel No. 3 - Borrow Area A parcel of submerged land lying in Palm Beach County, Florida, being more particularly described as follows:. Beginning at point in the Atlantic Ocean having for its coordinates Y = 766,919.91 and X = 809,839.63 in the Florida State Plane Coordinate System (East zone), thence run N 08°10'00"E 7118.46 feet to a point; thence run' S 81°50'00"E 800.00 feet to a point; thence run S 08o10, 00"W 7118.46 to a point; thence run N 81°50'00"W 800.00 feet to the Point of Beginning. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That the City of DelraY Beach, Florida, hereby submits the required resolution to the Bureau of Beaches and Shores, Department of Natural Resources for the Maintenance Nourishment Project for summer of 1977.
