Res 17-77 RESOLUTION NO. 17-77 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, VACATING AND ABANDON- ING THE NORTH-SOUTH ALLEY WHICH ABUTS LOTS 1-24, BLOCK 112, DELRAY H~IGHTS, LOCATED ON THE NORTH SIDE OF S.E. 455~ STREET, BETWEEN S.E. 5TH AVEN~/E AND S.E. 6TH AVENUE, SAID ABANDONMENT BEING SUBJECT TO THE RETENTION OF A FULL 16 FOOT UTILITY EASEMENT. WHEREAS, A.J. Adams, III, owner of Lots 1-16, Block 112, Delray Heights, and agent for Margaret C. Adams, o%roer of Lots 17-24, Block 112: Deiray !~eights, as r.ecorded in Plat Book 1, ~'age~ 130, Public Records of ~-a~Lt be,~ C,~unty, ?ior'.da, has~"'~-':~^~1~~ ~.~ City of abandonment of the North-South alley which abuts Lots 1-24, Block 1!2, Delray Heights; and, kqTEREAS, the City of Delray Beach, Florida, Engineering Depart- ment and the Planning and Zoning Board recommends that the North-South alley be abandoned with a full 16 feet being retained as a .utility easement throughout the length of the alley and that existing facilities not be disturbed; and, WHEREAS, the City Council of the City of Delray Beach deems it to be in the best interest of the City of Delray Beach to abandon said North-~outh 16 foot alley, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That pursuant to Chapter 166 Florida Statutes, it is hereby determined to vacate and abandon the following alley: The North-South 16 foot alley which abuts Lots 1-24, Block 112, Delray Heights, as recorded in Plat Book 1, Page 130, Public Records of Palm Beach County, Florida, located in Section 16-46-43, on the north side of S.E. 4th Street, between S.E. 5th Avenue and S.E. 6th Avenue, Delray Beach, Florida. Section 2. That the abandonment of the North-South 16 foot alley as described in Section 1 be effected subject to the retention of the full 16 feet as a utility easement throughout the length of the alley and that existing facilities not be disturbed.
