A RESOLUTION OF THE CITY COD-NCIL OF THE CITY OF
DELRAY BEACH, FLORIDA', REQUESTING PERMISSION FROM

ABINEXq~D TO ~tE CITY OF DELRAY BEACH FROM TItE COUNTY
ZONING CLASSIFICATION RH (RESIDENTIAL MULTIPLE
FAMILY) (HIGt{ DENSITY) TO THE CITY'S ZONING CLASS-
IFICATION PJ~-15 (MULTIPLE FAMILY DWELLING DISTRICT).
WHEREAS, the City of Delray Beach has received a request for
annexation from Edward Jo Pro~']se and Thomas A. Prouse,the owners of
the following described property:
Lot 15, FIRST ADDITION TO ICENMONT, Palm Beach
County, Florida~ according to the Plat thereof
recorded in the Office of the Clerk of the
Circuit Court in and for Palm Beach County, Florida,
in Plat Book 22, page 24, and the South 7½ feet of
the abandoned Alley running East and West between
said Lot 15 and Lot 22, Block 2, KENMONT, a Sub-
division of Palm Beach County, Florida, as recorded
in Plat Book 20, page 65 of the Public Records of
Palm Beach County, Florida;
and,
WHEREAS, the City Council has considered this annexation request
and upon the recommendation of the Planning and Zoning Board feels that
the proper zoning for this parcel of land, which would be in conform-
ance with the City of Delray Beach Land Use Plan, would be the City's
zoning classification RM-15 Multiple F~mily Dwelling District; and,
WHEREAS, Chapter 171.062 Florida Statutes requires that when a
'Municipality desires to annex property at a zoning classification, which
would permit lower density than is currently in effect under County
regulations, that the Municipality request and receive permission from
~e Board of County Commissioners for such. a change.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That the City Council hereby requests permission from
the Board of County Commissioners of Palm Beach County to rezone, when
annexed, the property described above from RH (Residential Multiple)
(High Density) to RM-15 (Multiple Family Dwelling District) which will
result in a 'decrease in the density allowed in such land.
Section 2. That a certified copy of this resolution is being
sent to each member of the Board of County Commissioners, the County
Administrator and the Director of Planning, Zoning and Building.
PASSED AND ADOPTED in regular session of this the 9th day of
May, 1977.
