Res 31-77 RESOLUTION NO. 31-77 A RESOLUTION OF THE CITY COUNCIL~OF THE CITY OF DELRAY BEACH, FLORIDA, REQUESTING PERMISSION FROM THE BOARD OF COUNTY COMMISSIONERS, PURSUANT TO FLORIDA STATUTES 171.062, TO REZONE LAND TO BE ANNEXED TO THE CITY OF DELRAY BEACH FROM THE COUNTY ZONING CLASSIFICATION AGRICULTURAL TO THE CITY'S ZONING CLASSIFICATION PRD-7 (PLANNED RESIDENTIAL) DISTRICT, WHEN THIS ZONING CLASSIFICATION IS ADOPTED. WHEREAS, the City of Delray Beach has received a request for annexation from Jack Dorson, the owner of the following described property: PARCEL 1: The NW¼ of Section 7, Township 46 South, Range 43 East, Less the N.988.55 feet thereof: and PARCEL 2: That part of the SW¼ of Section 7, Town- ship 46 South, Range 43 East, lying North of the North right-of-way line of Lake Ida Road, as shown on recorded plat of Delray Shores in Plat Book 24, pg. 233, Palm Beach County Public Records, and lying East of the extension of the West right-of-way line of Coral Way extended northerly to the half-section line of said Section 7, as shown on said plat of Delray Shores, less the East 40 feet thereof. and, WHEREAS, the City Council has considered this annexation request and upon the recommendation of the Planning and Zoning Board feels that the proper zoning for this parcel of land, which would be in conformance with the City of Delray Beach Land Use Plan, would be the City's zoning classification PRD-7 (Planned Residential) District; and, WHEREAS, Chapter 171.062 Florida Statutes requires that when a Municipality desires to annex property at a zoning classification, which would permit higher density than is currently in effect under County regulations, that the Municipality request and receive permission from the Board of County Commissioners for such a change. NOW~ THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That the City Council hereby requests permission from the Board of County Commissioners of Palm Beach County to rezone, when annexed, the property described above from Agricultural to PRD-7 (Planned Residential) District, which will result in an increase in the density allowed in such land. Section 2. That a certified copy of this resolution is being sent to each member of the Board of County Commissioners, the County Administrator and the Director of Planning, Zoning and Building.
