Res 54-77 RESOLUTION NO. 54-77 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, REQUESTING PERMISSION FROM THE BOARD OF COUNTY COMMISSIONERS, PURSUANT TO FLORIDA STATUTES 171.062, TO REZONE LAND TO BE ANNEXED TO THE CITY OF DELRAY BEACH FROM THE COUNTY ZONING CLASSIFIf~TION RM MULTIPLE TO THE CITY'S ZONING CLASSIFICATION R-1AA (SINGLE FAMILY DWELLING) DISTRICT. WHEREAS, the City of Delray Beach has received a request for annexation from Robert R. and Margaret M. Kipp, the owners of the following described property: That part of the South Half of the South Half of the Southwest Quarter~ of the Southeast Quarter of Section 20, Township 46 South, Range 43 East, Palm Beach County, Florida, more particularly described as follows: COMMENCE at the Southwest corner of the South Half of the Southwest Quarter of the Southeast Quarter of Section 20, Township 46 South, Range 43 East, thence run Easterly along the South Boundary of said tract (same being the South line of Section 20) a distance of 499 feet; thence Northerly parallel to the West boundary of said tract a distance of 30 feet to the point of beginning of this description; thence continue Northerly along the same course a distance of 178 feet; thence Easterly parallel to the South boundary of said tract a distance of 139 feet; thence Southerly parallel to the Western boundary of said tract a distance of 60 feet; thence Westerly parallel to the South boundary of said tract a distance of 69.75 feet; thence Southerly parallel to the Western boundary a distance of 118 feet; thence Westerly parallel to the South boundary of said tract and 30 feet therefrom a distance of 69.25 feet to the point of beginning; less South 23 feet deed to County of Palm Beach as recorded in Official Record Book 1694, page 803, of the Public Records of Palm Beach County, Florida. ALSO: COMMENCE at the Southwest corner of the S 1/2 of the S 1/2 of the Southwest quarter of the Southeast quarter, Section 20, Township 46 South, Range 43 East; thence run Easterly along the south boundary of said tract (same being the south line of Section 20, Township 46 South, Range 43 East; a distance of 568.25 feet; thence Northerly parallel to the West boundary of said tract a distance of 30 feet to the point of beginning of this description; thence continue Northerly along the same course a distance of 118 feet; thence Easterly parallel to the South boundary of said tract a distance of 69.75 feet; thence Southerly parallel to the Western boundary of said tract a distance of 118 feet; thence Westerly parallel to the South boundary of said Tract and 30 feet therefrom a distance of 69.75 feet to the point of beginning; less South 23 feet deeded to the County of Palm Beach as recorded in Official Record Book 1694, page 803, of the Public Records of Palm Beach County, Florida. The above described parcel contains 21,545 square feet and is located at 601 Linton Boulevard between S.W. 8th Avenue and S.W. 4th Avenue. WHEREAS, the City Council at the September 26, 1977, council meeting considered this annexation request and upon the recommendation of the Planning and Zoning Board at the meeting held on September 20, 1977, feels that the proper zoning for this parcel of land would be the City's Zoning Classification R-1AA (Single Family Dwelling) District; and, WHEREAS, Chapter 171.062 Florida Statutes, requires that when a Municipality desires to annex property at a zoning classification, which would permit lower density than is currently in effect under County regulations, that the Municipality request and receive permission from the Board of County Commissioners for such a change, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That the City Council hereby requests permission from the Board of County Commissioners of Palm Beach County to rezone, when annexed, the property described above from RM (Multiple) (County Zoning) to R-1AA (Multiple Family Dwelling) District (City Zoning) which will result in a decrease in the density allowed in such land. Section 2. That a certified copy of this resolution is being sent to each member of the Board of County Commissioners, the County Administrator and the Director of Planning, Zoning and Building.
