A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
DELRAY BEACH, FLORIDA, ACCEPTING THE LIFT STATION
AND GRAVITY SEWER MAINS IN HIGH POINT OF DELRAY
SUBDIVISION, SECTION 5, LOCATED NORTH OF DELRAY
WEST ROAD, SOUTH OF LAKE IDA ROAD, AND EAST OF
BARWICK ROAD, DELRAY BEACH, PALM BEACH COUNTY,
FLORIDA, AS OPERATIONAL AND SETTING THE INITIAL
SCHEDULE OF RATES, FEES AND OTHER RELATED CHARGES
TO BE IMPOSED FOR THE SERVICES AND FACILITIES
FURNISHED BY SAID SANITARY SEWER SYSTEM.
WHEREAS, James D. Carlton, Inc., Consulting Engineers for the above
project have certified as operational the lift station and gravity sewer
mains and found the entire system to be constructed in substantial com-
pliance with the approved plans and specifications as presented by said
Consulting Engineers, James D. Carlton, Inc., and previously approved by
the City of Delray Beach; and,
WHEREAS, the lift station and gravity sewer mains and related facili-
ties of said subdivision's sanitary sewer project have been inspected and
approved by personnel of the Delray Beach Public Utilities Department,
Sewer Division; and,
WHEREAS, it is deemed to be in the best interests of the affected
properties that the initial schedule of rates, fees and other charges be
imposed for the services and facilities furnished by the sewer system as
set forth in Resolution No. 1359 and in Article III, Sanitary Sewerage,
Chapter 27 of the Code of Ordinances of the City,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That the lift station and gravity sewer mains and related
facilities installed in High Point of Delray, Section 5 Subdivision, as
above described, are hereby accepted by the City as being operational and
subject to the initial schedule of rates, fees and other charges as pre-
viously established, and applicable thereto.
Section 2. That nothing herein contained shall be construed as dis-
charging the contractor from the strict performance of his remaining con-
tractual duties. That the contractor, and bonding companies remain
responsible in all respects until released in accordance with the con-
tractual agreement.
