Res 65-77 RESOLUTION NO. 65-77 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, ACCEPTING THE WATER DISTRI- BUTION SYSTEM AND THE SEWAGE COLLECTION/TRANSMISSION SYSTEM WHICH INCLUDES A SEWAGE PUMP STATION, CON- STRUCTED TO SERVE ARBY'S INTERNATIONAL RESTAURANT, LOCATED ON SOUTHEAST 9TH STREET AND SOUTHEAST 5TH AVENUE, DELRAY BEACH, AS OPERATIONAL AND SETTING THE INITIAL SCHEDULE OF RATES, FEES AND OTHER RELATED CHARGES TO BE IMPOSED FOR THE SERVICES AND FACILI- TIES FURNISHED BY SAID SYSTEMS. WHEREAS, John A. Grant, Jr., Consulting Engineers for the above pro- jects have certified that said systems were designed and constructed substantially in accordance with the Rules of the Palm Beach County Depart- ment of Health and Rules of the Department of Environmental Regulation, and previously approved by the City of Delray Beach; and, WHEREAS, the above systems have been inspected and approved by personnel of the Delray Beach Public Utilities Department, and, WHEREAS, it is deemed to be in the best interests of the affected properties that the initial schedule of rates, fees and other charges be imposed for the services and facilities furnished by the sewer system, as set forth in Resolution No. 1359 and in Article III, Sanitary Sewerage, Chapter 27, of the Code of Ordinances of the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That the water distribution system and the sewage collection/transmission system which includes a sewage pump station, as above described, are hereby accepted by the City as being operational and subject to the initial schedule of rates, fees and other charges as previously established, and applicable thereto. Section 2. That nothing herein contained shall be construed as dis- charging the contractor from the strict performance of his remaining con- tractual duties. That the contractor, and bonding companies, remain responsible in all respects until released in accordance with his con- tractual agreement.
