Res 35-76 RESOLUTION NO. 35-76 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, REQUESTING PEPd~ISSION FROM THE BOARD OF COUNTY CO~'~4ISSIONERS, PURSUANT TO FLORIDA STATUTES 171.062, TO REZONE LA/qD TO BE ANNEXED TO TtIE CITY OF' DELRAY BEACH FROM THE COUNTY ZONING CLASSIFICATION RS (RESIDENTIAL SINGLE FAMILY) TO THE CITY'S ZONING - CLASSIFICATION RM-15 (MULTIPLE FAMILY DWELLING DISTRICT). WHEREAS, the City of Delray Beach has received a request for annexation from Henry D. Roberson and Marjorie S. Roberson, his wife, the owners of the following described property: · Lots 5] through 56, Block 35, Del Raton Park Subdivision, as recorded in Plat Book i4~ Page 9 of the Public Records of Palm Beach County, F16rida; and, ~{EREAS, the City Council has considered this annexation request and upon the recommendation of the Planning and Zoning Board feels ~hat the proper zoning for this parcel of land, which would be in conformance with the City of Delray. Beach Land Use Plan, would be the City's zoning classi- fication ~-15 Multiple Family Dwelling District; and WHEREAS, Chapter 171.062 Florida Statutes requires that when a Municipality desires to annex property at a zoning classification, which would permit higher density than is currently in effect under County regu- lations, that the Municipality request and receive permission from the Board of County Commissioners for such a change. · NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That the City Council hereby requests permission from the Board of County Co]~]issioners of Palm Beach County to rezone, when annexed, the property described above from RS (Residential Single Family) to RM-15 (Multiple Family Dwelling District) which will result in an ~increase in the density allowed in such land. Section 2. That a Certified copy of this resolution is being sent to each member of the Board of County Commissioners, the County Administrator and the Director of Planning, Zoning and Building.
