A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
DELRAY BEACH, FLORIDA, TO THE COUNTY COURT OF PALM
BEACH COUNTY EXPRESSING CONCERN THAT THE COUNTY
COURT POLICY WITH REGARD TO THE PENALTY FOR SOLICITING
FOR PROSTITUTION IS SO LENIENT.
WHEREAS, Delray Beach has a considerable problem with regard to
individuals soliciting for prostitution; and,
WHEREAS, the City of Delray Beach Police Department has made a
concerted effort to correct this problem through the arrest of Violators
and the presentment of cases to the proper court; and,
WHEREAS, it has been the policy of the Municipal Court of Delray
Beach to impose a first conviction penalty for this'offense as follows:
$300.00 fine, $11.00 court costs and a mandatory ten .day jail sentence; and,
WHEREAS, to avoid the penalty imposed by the Municipal Court of
the City of Delray Beach, violators are having their cases transferred to
the County Court of Palm Beach County whose policy with regard.to this type
of violation on the first conviction is a $25.00 fine; and,
WHEREAS, the City Council of the City of Delray Beach is -_-~'
extremely disappointed and surprised by the leniency being shown to the .~
people violating the prostitution laws; and,
WHEREAS, the $25.00 fine currently imposed for first offense by
the County Court of Palm Beach is totally inadequate to.deter these people
from immediately returning to the streets and engaging in the illegal
activity,
NOW, THEREFORE, BE 'IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That the City Council of the City of Delray Beach
respectfully requests the County Court of Palm Beach County to review and
revise its policy with regard to the imposition of penalties for violation
of the prostitution laws with a view toward making such penalties more
realistic to deter future crime of this type.
Section 2. That copies of this resolution shall be sent to all
of the County Court Judges of Palm Beach County.
PASSED AND ADOPTED in regular session on this the 9th day of
August, 1976.
