Res 52-76 RESOLUTION NO. 52-76 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, REAFFIRMING THE SUPPORT OF THE CITY OF DELRAY BEACH FOR THE PROPOSED CONSTRUCTION OF THE SOUTH TWELFTH STREET BRIDGE OVER THE INTRACOASTAL WATERWAY. WHEREAS, the city of Delray Beach has passed and adopted Resolution Nos. 24-69, 27-70 and 6-72, which are attached hereto and made a part hereof; and, Wt{EREAS, said resolutions point out the critical need for the construction of the South 12th Street Bridge; and, WHEREAS, the critical need derives from the excessive use of the Atlantic Avenue Bridge which creates a problem in providing prompt and efficient fire, police, ambulance and other emergency services for the southeast area of the city, lying east of the Intracoastal Waterway; and, WHEREAS, the construction of the proposed South 12th Street Bridge has been in the planning stages for many years and such planning being a matter of public record; and, WHEREAS, the lawsuit was filed in August of 1976 proposing that at this late date the construction of the South 12th Street Bridge be halted; and, ?UwlEREAS, it is extremely unfair and inequitable for such a suit to be filed at this time in view of the public planning that has taken place for this project over the period of several years; and, WHEREAS, the City Council of the City of Delray Beach wishes to go on record as reaffirming its continuing and wholehearted support for the construction of the proposed South 12th Street Bridge, NOW, THEREFORE, BE IT RESOLVED BY ~{E CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: SECTION 1. That the City Council of the City of Delray Beach hereby reaffirms its support of the proposed South 12th Street Bridge as evidenced by Resolution Nos. 24-69, 27-70, 6-72 and this resolution. SECTION 2. That the Board of County Commissioners of Palm Beach County and the Florida Department of-Transportation are hereby respectfully requested to do everything possible to defend the above referred to law- suit and complete the construction of the proposed South 12th Street Bridge which has been planned for many years. SECTIOn; 3. That a certified copy of this resolution be sent to each member of the Board of County Commissioners of Palm Beach County and the Florida Department of Transportation. A RESOLUTION OF THE CITY COUNCIL OF THE CITY'OF DELRAY BEACIt, FLORIDA, REQUESTING TIlE PALM BEACH COUNTY COblMISSION TO RECOG- NIZE TIIE CRITICAL NEED FOR, AND PROVIDE CONSTRUCTION OF, THE PROPOSED SOUTII TWELFTIt STREET BRIDGE OVER TIlE INTRACOASTAL WATE~¢AY. WHEREAS, as a result of traffic surveys during the recent tour- ist season showing up to 1050 cars per hour using the Atlantic Avenue bridge, which exceeds the original design capacity of the bridge; and WHEREAS, during the recent tourist season, the Atlantic Avenue bridge was opened for the passage of boats as many as 8 times per hour and remained open for a period of 2.36 minutes minimum to a max- imum Of 6.65 minutes; and WHEREAS, the bridge was not useable by automobiles numerous times as a result of breakdowns, which breakdowns lasted for a period of 1 to 4 hours; and WHEREAS, at times when bridge was not useable, it would take up- wards of 45 minutes to detour and cross the 8th Street bridge; and WHEREAS, during times when bridge was not useable, prompt and efficient fire, police, ambulance and other emergency services for the citizens were not available to the section of Delray Beach lying east of the Intracoastal Waterway; and WHEREAS, during the period of January, 1968, through March, 1969, a fifteen-month period, building permits have been issued, and Site ~ .Plan approval given, for the area lying within the City, south of ,Atlantic Avenue, and west Of the Intracoastal Wate~.~ay for 1325 dwell- ing units, the residents of which will desire to utilize the beach area; and WHEREAS, during said fifteen-month period building permits were issued for the area, east of the Intracoastal Waterway for 705 dwell- ing units the residents of which will have to cross the Intracoastal Wate~vay daily to shop and visit in the central part of the City; and WHEREAS, Delray Beach is negotiating a sewer contract with the Town of Highland Beach predicated upon 1200 units being built in the north end of Highland Beach, of which many are now under construction, -' and all of which will need to cross the Intracoastal Waterway; and WHEREAS, the current year-round population of Delray Beach is 17,941, and during the season is approximately 35,000, not including new construction; THEREFORE, be it resolved by the City Council of Delray Beach, Florida, that: The County Commissioners of Palm Beach County ~)e advised of. these matters and 'that the County Commissioners of Palm Beach County are requested to do everything possible to procure tt,e installation of the planned 12th Street bridge in Delray Beach so that movement of the traffic can be facilitated and protection of public can be greatly enhanced. WI-tEREAS, as a result of traffic surveys during the recent tourist season showing up to 1100 cars per hour using the Atlantic Avenue bridge, which .exceeds the original design ca- pacity of the bridge; and WHEREAS, during the. recent tourist season, the Atlantic Avenue bridge was opened for the passage of boats as many as 8 times per hour and remained open for a period of 2.5 minutes minimum to a maximum of 6.0 minutes; and WHEREAS, the bridge was not useable by automobiles numer- ous times as a result of breakdown, which breakdowns lasted for a period of 1 to 4' hours; and WHEREAS, at times when bridge was not useable, it would take upwards .of 45 minutes to detour and cross the 8th Street bridge; and WI~EREAS, during times when bridge was not useable, prompt and efficient fire, police, and ambulance and other emergency services for the citizens were not available to the section of Delray Beach lying east. of the Intracoastal Waterway; and WHEREAS, there are currently under construction, over 3,000 dwelling units in areas adjacent to the Intracoastal Waterway, including new High Rise Apartments in Highland Beach immediately south of our City limits on South A1A. The major portion of the tenants who will be occupying these apartments and dwelling units will be crossing the Atlantic Avenue bridge; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, THAT; The County Commissioners of Palm Beach County be advised of these matters and that the County Commissioners of Palm Beach County are requested to do everything possible to procure the installation of the planned Twelfth Street bridge in Delray Beach, at the earliest possible date, in order to lessen the present traffic paralysis to the public. LRAY ]3~,ACII, FLORIDA, R)~QU ~IIN( DEPARTMENT OP TRANSPORTATION OF TIlE STATE OF FLORIDA TO BUDGET FUNDS FOR TIlE CONSTRUCTION OF THE CRITICALLY NEEDED PROPOSED SOUTH 'I~NELFTH STREET BRIDGE OVER TIIE INTRACOASTAL WATERWAY. WHEREAS, the right of way has all been procured, and the Coast Guard is holding hearings on the South 'fwelfth Street . Bridge in Delray Beach, Florida; and WHEREAS, the present Atlantic Avenue Bridge in Delray Beach on State Road S-806 was opened J.n 1952 when the official census for Delray Beach was 6,312; and. WHEREAS, the 1970 census for Delray Beach was .19,366, · estimated at present to be 21,500 and projected for 1975 to be 29,000, with 5,250 units in process as of December 31, 1971, to which can be adddd facilities for 9,000 tourists which has become a year round business; and WHEREAS, this rapid growth in population has resulted in more vehicle t.raffic over the 20-year-old Atlantic Avenue Bridge which far exceeds the original design capaci.ty; and WHEREAS, the population growth all along the east coast has created a large increase in boat traffic resulting in more raisings and lowerings of the Atlantic Avenue bridge for which the equipment was not designed thereby resulting in breakdomn~s; and WHEREAS, due to the low clearanc~ of 14 feet for the Atlantic Avenue Bridge, it is estimated that the bridge must be raised for 50 per cent of the boats using the Intracoastal Waterway; and WHEREAS, during a recent period, the Atlantic Avenue 'Bridge was opened for the passage of boats as many as 8 times per hour and remained open for a period .of 2.36 minutes minimum to a maximum of 6.65 minutes; and WHEREAS, the bridge was not useable by vehicles numerous times as a result of breakdowns, which breakdowns lasted for a period of 1 to 4 hours; and WHEREAS, at times when bridge was not useable, it'would take upwards of. 45 minutes to detour and cross the 8th Street bridge; and WHEREAS, during times when bridge' was not useable, prompt and efficient fire, police, ambulance and ether emer- gency services for the citizens were not avail, able to the section of Delray Beach lying east of the Intracoastal Water- way; and Page 2. WHEREAS, the present traffic on S-806, also known as Atlantic Avenue, in Delray Beach, is congested many times daily wit]] the stacking of traffic for bridge openings and breakdowns and stacking of traffic for 'train crossing to such an extent that nor. th and south bound traffic on U. S. l, in. Delray Beach, · is impeded and sometimes blocked because of such stacking of traffic; and %qHEREAS, the proposed South Twelfth Street Bridge in Delray Beach will be of a maximum height which will necessitate fewer openings for boat traffic and faster movement of vehicles; . and WHEREAS, as a result of the fewer openings, the following traffic will utilize the Twelfth Street Bridge in going to areas east of the Intracoastal Water~.?ay, and thereby reduce the traffic on Atlantic Avenue, namely: (a) People using 1-95, whose destination is east of the Intracoastal Waterway, will utilize the interchange at 12th Street and avoid Atlantic Avenue traffic, traffic lights and bridge openings and breakdowns. ~) Most trucks and commercial v~ehicles would ~tilize the South Twelfth Street Bridge for the resultant savings in tim.e as a result of avoiding the heavy traffic on Atlantic Avenue and the uncertainty, of bridg.e openings and br e ak down s. ' (c) City garbage and trash trucks h~uling to the transfer station located south of 12th Street. (d) The City's only snorkle fire engine which ' is statJ~oned on 12th Street with most high-rise build-ings ]Being east of the waterway. ~ItEREAS, the Town of Highland Beach with a population in 1969 of'200 and today has 1,700 and has plans in.process for the construction of approximately 2,000 more living units adds greatly to the Atlantic Avenue bridge congestion problem and would use the new South 5%~elfth Street Bridge. T!3_EREFORE, be it resolved by the City Council of Delray · Beach, Florida, that: The Department of Transportation of the State of Florida ]De advised of these matters to illustrate the necessity for promptly moving forward by budgeting funds necessary for the construction of the South Twelfth Street Bridge in Delray Beach to help ease serious traffic problems with which the City is confronted today and which will be getting worse with each passing day. .
