Res 54-74 RESOLUTION NO. 54-74. A RESOLUTION OF THE CITY COUNCIL OF TH~ CITY OF DELRAY BEACH, FLORIDA, VACATING ~ND ABANDONING THE NORTH-SOUTH SIXTEEN FOOT ALLEY LYING BETWEEN LOTS 1 THROUGH 5 AND LOTS 6 THROUGH 8, BLOCK 6, RIO DEL REY SUBDIVISION; AND VACATING AND ABANDONING THE NORTH-SOUTH SIXTEEN FOOT ALLEY LYING BETWEEN LOTS 1 THROUGH 6 ~D LOTS 7 THROUGH 12, SANBORN- STONE SUBDIVISION. WHEREAS, JOSEPH F. KEELEY, Agent, for Nora Schweihs and Francis John Schweihs, owners of Lots 1 through 8, Block 6, Rio Del Rey Sub- division, according to Plat Book 12, page 84, Public Records of Palm Beach County, Florida, has petitioned the City of Delray Beach for abandonment of the North-South I~ foot alley lying between Lots 1 through 5 and Lots 6 through 8, Block 6, Rio Del Rey Subdivision; and, WHEREAS, PHILLIP T. CRENSHAW/'Agent, for Atlantic Building Corporation, owner of Lots 1 through 12, Sanborn-Stone Subdivision, according to Plat Book 12, Page 63, Public Records of Palm Beach County, Florida, has petitioned the City of Delray Beach for abandon- ment of the North-South 16 foot alley lying between Lots 1 through 6 and Lots 7 through 12, Sanborn-Stone Subdivision; and, WHEREAS, this matter was referred to the Planning and Zoning Board and after due consideration, they recommended that the above described properties be abandoned in their entirety, including the existing five (5') pub!i~ utility easement; and, WHEREAS, the City Council deems it to be in the best interest of the City.to abandon said North-South alley in Rio Del Rey Subdivi- sion and said North-South alley in Sanborn-Stone Subdivision, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA: 1~. That pursuant to Section Seven (7), Paragraph Three (3) of the Charter of the City of Delray Beach, Florida, it is hereby deter- mined to vacate and abandon the following described right-of-way: The North-South sixteen foot alley lying between Lots I throug~ 5 and Lots 6 through 8, Block 6, Rio Del Rey Subdivision, as recorded in Plat Book 12, Page 84, of the Public Records of Palm Beach County, Florida; and~ The North-South sixteen foot alley lying between Lots 1 through 6 and Lots 7 through 12, Sanborn- Stone Subdivision, as recorded in Plat Book 12, Page 63, of the Public Records of Palm Beack County, Florida.
