Res 65-74 RESOLUTION NO. 65-74. RESOLUTION OBJECTING TO REDUCTION OF FEDERAL FUNDS FOR SEWERAGE CONSTRUCTION GRANTS, AND REQUESTING REVIEW AND CHANGES IN P. L. 92-500 AND FEDERAL REGU- LATIONS TO ENABLE THE MOST EFFECTIVE, EFFICIENT, AND PRODUCTIVE USE OF FEDERAL SEWERAGE CONSTRUCTION GRANT FUNDS. WHEREAS, the Palm Beach Area Planning Board in conjunction with the U. S. Environmental Protection Agency and the State of Florida Department of Pollution Control, has developed the Water Quality Management Plan for Palm Beach County, which outlines the development and designates the agencies for development of regional sanitary sewerage systems in Palm Beach County, Florida; and, WHEREAS, the purpose for said Water Quality Management Plan for Palm Beach County is to coordinate the development of sanitary sewerage facili- ties in a manner to bring sewerage facilities and waters receiving treated sewage effluents into compliance with laws, rules, and regulations promul- gated and adopted by State and Federal regulatory agencies to safeguard the health of the citizens, protect the nation's valuable water resources and to enhance the environment; and, WHEREAS, the City of Delray Beach in conjunction with the City of Boynton Beach has been charged with the responsibility for the development of a regional sewage treatment and disposal facility; and, WHEREAS, large expenditures of funds, beyond the financial capabili- ties of the City of Delray Beach, are necessary to implement the develop- ment of said regional sanitary sewerage system; and, WHEREAS, Public Law 92-500 and the rules, guidelines, and regulations adopted by the U. S. Environmental Protection Agency to implement said law are so highly restrictive and all-inclusive that long delays have been encountered in getting sanitary sewerage projects under construction where federal funds are assigned that many needed projects have been unneces- sarily delayed because of an inequitable distribution of federal construc- tion grant funds; and, WHEREAS, the long delays caused by extremely restrictive federal legislations and rampant inflation have caused tremendous increases in construction costs reducing the productivity of federal funds thereby further contributing to the critical inflation problem, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: SECTION 1. The City Council hereby files strong objections to any reductions in federal construction grant funds for sanitary sewerage pro- jects under Public Law 92-500. SECTION 2. The City Council hereby requests that the Executive and Legislative Branches of the United States Government in conjunction with State, County, and Municipal officials, who have had. actual and practical experience in the development of sanitary sewerage systems, make a critical review of Public Law 92-500 and the rules, regulations, and guidelines for implementation of this act and make recommendations to the Congress and other federal agencies for changes in the legislation, rules, regulations and guidelines to allow the most effective, efficient and productive use of said federal sewerage construction grants. SECTION 3. Elizabeth Arnau, City Clerk, is hereby directed to forward copies of this Resolution to the following: a. President of the United States of America b.
