A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
DELRAY BEACH, FLORIDA, AMENDING THE COMPREHENSIVE
LAND USE PLAN FOR THE CITY OF DELRAY BEACH BY
CHANGING TO CO~LMERCIAL CLASSIFICATION THE AREA
LOCATED EAST OF NORTH FEDER3XL HIGHWAY EXTENDING
FROM N.E. 8TH STREET NORTHWARD TO GULFSTREAm4
BOULEVARD, BEING A~N IRREGULARLY S~{APED PARCEL
LYING IN SECTION 9, TOW/qSHIP 46 SOUTH, RANGE 43
EAST.
WHEREAS, the Planning and Zoning Board, after investigation and
study, has recommended an amendment to the Comprehensive Land Use
Plan; and,
WHEREAS, City Council has reviewed the proposed amendment at
workshop; and,
WHEREAS, City Council authorized the City Clerk to publish notice
for two weeks for a Public Hearing to be held before adoption of the
amendment; and,
WHEREAS, the City Clerk published notice on October 31 and November
7, 1974, of the Public Hearing; and,
WHEREAS, City Council held a Public Hearing pertaining to the
amendment on'November 12, 1974,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DEL~AY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That the Land Use Plan adopted August, 1972, be changed
to Show Commercial Land Use classification in the following described area
Commence at the intersection of the east right-of-way
line of U.S. Highway One and the east line of the
Subdivision of Delray Beach Estates as recorded in
Plat Book 21, at Page 13, Palm Beach County Public
Records for the point of beginning of herein described
property; thence in a southerly direction along said
east line of Delray Beach Estates and the southerly
extension thereof to a point in the north line of
Section 9, Township 46 South, Range 43 East; thence
in a westerly direction along said south line of
Section 9, Township 46 South, Range 43 East to a point;
said point being 250 feet east of, as measured at right
angle to the centerline of said U.S. Highway One;
thence in a southerly direction parallel to and 250
feet as measured at right angle to said centerline of
U.S. Highway One, to a point in the east-west center-
line of said Section 9, Township 46 South, Range 43
East; thence in a westerly direction along said east-
west centerline of Section 9, to a point in the said.
east right-of-way line of U.S. Highway One, said east
right-of-way line being 50 feet east of, as measured
at right angle to said centerline of U.S. Highway One;
thence in a nor.therly direction along said east right-
of-way line of U.S. Highway One to the point of
beginning.
And also including:
That portion of Lot 4 of the Subdivision of Section
9, Township 46 South, Range 43 East, plat of which
is recorded in the office of the Clerk of the Circuit
Court, Palm Beach County, Florida, in Plat Book 8,
Page 40; said portion of Lot 4 being bounded on the
west by the center line of U.S. Highway No. 1 and
bounded on the East by the center line of N.E. 7th
Avenue, as shown upon the Plat of Sophia Frey Sub-
division, as recorded in Plat Book 4, Page 37, if
extended northward.
Section 2. That the Planning Director is authorized to make such
correction to the Land Use Plan adopted August, 1972.
Section 3. This Resolution shall become effective immediately
upon passage.
PASSED AND ADOPTED in regular session on November 12, 1974.
