A RESOLUTION OF THE CITY COUNCIL OF THE 'CITY OF DELRAY
BEACH, FLORIDA, AUTHORIZING NEGOTIATION OF A CONTRACT FOR
FURNISHING, HAULING AND STOCKPILING FILL AT A' DRAINAGE
POND (KNOWN AS PRIEST POND) LOCATED BETWEEN SOUTHWEST 3RD
STREET, SOUTHWEST 3RD COURT AND SOUTHWEST 8TH AVENUE,
SOUTHWEST 10TH AVENUE, CITY OF DELRAY BEACH, FLORIDA.
WHEREAS, it is the recommendation of the City Manager that the Council,
acting by authority of provisions of Section 78 of the City Charter, award
a contract for furnishing, hauling and stockpiling fill at the site of a
drainage pond (known as Priest Pond) located between Southwest 3rd Street,
Southwest 3rd Court and Southwest 8th Avenue, Southwest 10th Avenue, Delray
Beach, Florida.
WHEREAS, in the progress of construction of the Southwest Storm Drainage
System, there was excess fill that could be deposited at an area designated
by the City of Delray Beach, and
WHEREAS, the site of the drainage pond (known as Priest Pond) located
between Southwest 3rd Street, Southwest 3rd Court and Southwest 8th Avenue,
Southwest 10th Avenue, no longer needed in connection with the Southwest
Drainage System, has been declared a nuisance and a health hazard; all excess
fill was designated for this area but was not sufficient in quantity to com-
pletely fill the drainage pond (known as Priest Pond), and
WHEREAS, a price of $1.25 per cubic yard for furnishing, hauling and
stockpiling fill was received from Mr. Sam Pittman of the Trucking and Ex-
cavating Company of Boca Raton, Florida, and
WHEREAS, the City Engineering Office certifies the quoted price to be
reasonable, and that the drainage pond (known as Priest Pond) located be-
tween Southwest 3rd Street, Southwest 3rd Court and Southwest 8th Avenue,
Southwest 10th Avenue, Delray Beach, Florida, continues to be a nuisance and
a health hazard; therefore, it is recommended that the City of Delray Beach,
Florida, enter into a contract with Mr. Sam Pittman of the Trucking and Ex-
cavating Company of Boca Raton, Florida, to purchase fill in the amount of
6,500 cubic yards ~ $1.25 per cubic yard for a total of $8,125.00, and
WHEREAS, it is the Council's opinion that the award of this contract
would be in the best interest of the City,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DELRAY BEACH, FLORIDA, AS FOLLOWS:
SECTION 1. That said contract for furnishing, hauling and stockpiling
fill be awarded to Mr. Sam Pittman of the Trucking and Excavating Company of
Boca Raton, Florida, in the amount of $8,125.00.
SECTION 2. That this improvement shall be funded with money from
revenue sharing funds.
PASSED AND ADOPTED in regular session on this the 12th d~y of
