A RESOLUTION OF TIlE CITY COUNCIL OF TIlE CITY OF DELRAY
BEACII, FLORIDA, REQUESTING TIlE PALM BEACII COUNTY
COM_MISSIONERS TO CHANGE TIlE ZONING ON SOUTtt A1A IN
DELRAY BEACH SO TIIAT IT WILL BE COMPATIBLE WITH ZONING
IN THE CITY OF DELRAY BEACH.
WHEREAS, The County of Palm Beach and the City of Delray Beach are
in a program of cooperation in the zoning of areas affecting Delray Beach;
and,
WHEREAS, through the history of the development of the area lying on
A1A bounded on the North by Lewis Cove Road and its extension eastward to
the ocean and on the South by Tropic Boulevard extended eastward to the
ocean has been multi-family development on the east of AIA and single-
family on the west of A1A, much of which was done by deed restrictions with
no commercial uses; and,
WHEREAS, this area has several County pockets completely surrounded
by the City of Delray Beach which are zoned by the County as commercial
and which Delray Beach shows on their land use plan for future zoning of
single-family residences on the west of A1A and multi-family on the east of
A1A which zoning is the same as the surrounding property within the City
with no commercial uses allows; and,
WHEREAS, this incompatibility between the County and City zoning
should not exist; and,
WHEREAS, the City Council respectfully requests the County's
adherence to or observance of the City's Master Plan in all actions
considered by the County,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DELRAY BEACH, FLORIDA, AS FOLLOWS:
The City Council of Delray Beach strongly urges that the Palm Beach
County Commissioners make the following changes as to the County Land
located:
1. On the west of A1A, between Lewis Cove on the north and
Del Haven Drive on the south, lying in Section. 21, Township 46 South, Range
43 East, be designated as having a single-family land use classification on
the County Land Use Plan; and that the County in its comprehensive analysis
of the comparison between existing zoning and the land use plan, rezone this
area to single-family residential.
2. On the east side of A1A, between Lewis Cove extended to
the ocean on the north and Dogwood Drive extended to the ocean on the south,
lying in Section 21 and 28, Township 46 South, Range 43 East, be designated
as having a medium density residential land use classification on the County
Land Use Plan; and that the County in its comprehensi~,e analysis of the
comparison between existing zoning and the land use plan, rezone this area
to medium density residential.
3. On the west side of A1A, between Tropic Boulevard extended
'to A1A on the north and Dogwood Drive extended to A1A on the south lying in
Section 28, Township 46 South, Range 43 East, be designated as having a
medium density residential land use classification on tile County Land Use
Plan; and that the County in its comprehensive analysis of the comparison
between existing zoning and tile land use plan, rezone this area to medium
· density residential.
Copies of this resolution shall be furnished to members of the Palm
Beach County Commission and members of the Palm Beach County Planning
Commission.
