Res 12-73 RESOLUTION NO. 12-73. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, ACCEPTING ALL SA/~ITARY SEWERS INSTALLED IN THE SUBDIVISION OF DELRAY ESTATES AS OPERATIONAL AND SETTING THE INITIAL SCHEDULE OF RATES, FEES AND OTHER CHARGES TO BE IMPOSED FOR THE SERVICES AND FACILITIES FUR- NISHED BY SAID SANITARY SEWERS. WHEREAS, the City Engineer has certified as operational all Sanitary Sewers and related facilities as shown on the Pre- liminary Plat of Delray Estates as presented by the developer, and previously approved by the City of Delray Beach; and, WHEREAS, it is deemed to be in the best interest of the affected properties that the initial schedule of rates, fees and other charges to be imposed for the services and facilities furnished by the Sewer System, as set forth and contained in Resolution No. 1359 and in Article III, Sanitary Sewerage, Chapter 27 of the Code of Ordinances of the City shall become effective the first day of April, 1973, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DELRA¥ BEACH, FLORIDA, AS FOLLOWS: 1. That all Sanitary Sewers and related facilities installed in the Subdivision of Delray Estates are hereby accepted by the City as being operational and the initial schedule of rates, fees and other charges previously established, and applicable there%o, shall become effective April 1, 1973. 2. That nothing herein contained shall be construed as discharging the developer from the strict performance of his remaining contractual duties. That the developer and his bond remain responsible in all respects until released in accordance with his agreements with the City. Hr. Paul Nicolls, Superintendent of Water Department, and Mr. Carl Howard, Superintendent of Sewer Department were present during final inspec- tion of all sewer and water construction and both approved the project. It has been requested that this office furnish the City of Delray Beach with proper certifications for these improvements.
