09-90 ORDINANCE NO. 9-90 AN ORDINANCE OF T.~E CITY COMVISSION OF THE CITY OF DELlq^Y BEACH, FLORIDA, AVENDING TITLF YIII, "GENERAL OFFENSES", OF THE CODE OF ORDINANCES OF THE CITY OF DELRAY BEACH, FLOI~IDA; BY A~FNDING CHAPTER 132, "OFFENSES AGAINST PUBLIC PEACE AND SAFETY", BY ENACTING A NEW SECTION 132.09, "SKATEBOARDING AND TFF, LIKE PROHIBITED", PROVIDING FOR lqFSTRICTIONS IN CEP. TAIN AREAS; PROVIDING FOR A GENERAL REPFAI,ER CLAUSF; PR. OVID- ING A SAVING CLAUSE; P]~OVIDING AN EFFECTIVE DATE. WHEREAS, the area in the vicinity of the sidewalk alonp'. Atlantic Avenue, is frequently congested with pedestrian traffic and skateboarding, roller-skates, and the like, create an additional hazard. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DEl, RAY .m. EACIq, FLORIDA, AS FOLLOWS: Section 1. That Title XIII, "General ©ffenses", Chapter 132, "Offenses Against Public Peace and Safety", of the Code of Ordinances of the City of Delra¥ Beach, Florida, be, and the same is hereby, amended to enact a new Section 132.09, "Skateboarding and the Like Prohibited", to read as follows: §132.09 Skateboarding and the I.ike Prohibited. It shall be unlawful for any person upon roller skates, skateboards, bic,.Tcles, or riding in or by any means of any coaster, toy vehicle, .olay vehicle, or similar device: (A) With the exception of bicycles,to a'o uDon any sidewalk alo.np~ Atlantic Avenue between A-1-A on the east and 1-95 on the west. (.lq) To operate said devices in a reckless manner on any .nublic sidewalk. No person shall ride a skateboard or roller-skate on a sidewalk without e.~carcisin~ due care for the safety of others using the sidewalk. Section 2. That all ordinances or parts ef ordinances which are in conflict herewith are hereby repealed. Section 3. That should any section or provision of this ordi~:ance or n~-.r portion thereof, any paragraph, sentence, or word be declared by ~ court of comnetent jurisdiction to be invalid, such decision shall not affect the validity of the renal.oder hereof as a whole or part thereof other than the part declared to be iP. valid. Section 4. That this ordinance shall become effective ten (10) days after its passage on second and final reading.
