A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF DELRAY BEACH, FLORIDA, APPROVING
THE COUNTY'S PROPOSED METHOD OF PROVIDING
WATER AND SEWER SERVICE TO SERVE AREAS
LYING WEST OF THE RESERVE AREA OF THE
CITY OF DELRAY BEACH.
WHEREAS, Mr. Robert Cook, Assistant County Attorney
for Palm Beach County, has requested the City Council of Delray
Beach to pass a resolution pertaining to water and sewer facili-
ties for areas lying west of the City's reserve area and that
portion of a development known as Villadelray which lies within
the City's reserve area;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF DELRAY BEACH, FLORIDA, that:
1. Providing the use of wells will not now, or in
the future, have any adverse effect on the water table as
presently used or as to be expanded in the future by the City
of Delray Beach; and
2. Providing that the discharge of sewerage will not
have any adverse effect on the water supply as presently consti-
tuted or to be developed in the future by the City of Delray
Beach; and
3. Providing that if such facilities are installed
the city of Delray Beach can obtain the transfer of such water
and sewerage facilities to the City of Delray Beach by the city
of Delray Beach paying the sum of $1.00 at the time the city of
Delray Beach elects to include these facilities in its water and
sewerage system; and
4. That subject to the above provisions, the City
Council of Delray Beach gives its approval to Palm Beach County
for granting water and sewer agreements in the above areas.
PASSED and ADOPTED in regular session on this the
22nd day of November, 1971.
