Res 26-70 RESOLUTION NO. 26-70. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AUTHORIZ- ING THE EXECUTION OF AGREEMENT FOR PRO- VIDING CONNECTION OF THE WATER SYSTEMS OF DELRAY BEACH AND HIGHLAND BEACH TO GUARD AGAINST THE POTENTIAL DANGER OF EITHER SYSTEM'S FAILURE EAST OF THE INTRACOASTAL WATERWAY, AND TO PROVIDE FOR EQUAL SHARING OF SUCH INSTALLATION COST. BE IT RESOLVED, by the city Council of the City of Delray Beach, Florida, a Florida municipal corpo- ration, as follows: 1. That the city of Delray Beach, a municipal cor- poration of the State of Florida does hereby deem it in the best interest of the citizens of this City, east of the Intracoastal Waterway, to enter into an agreement with the Town of Highland Beach, a municipal corporation, for establishing an operational connection of the Water Systems of both Delray Beach and Highland Beach. 2. The Mayor is hereby authorized to execute an AGREEMENT between the two municipalities providing for such installation to effect an emergency supply of water from either municipal area to the other in case of either system' s failure. 3. Highland Beach shall cause to be made the neces- sary connection and operational valves in accordance with specifications to be furnished by the City of Delray Beach. Total cost of such installation, including all appurte- nances relating thereto, shall be shared equally between the two corporations, and said AGREEMENT, properly executed, is attached hereto and made a part hereof. PASSED AND ADOPTED on this 23rd day of March, 1970. .MAYOR ATTEST .,-, AGREEMENT THIS AGREEMENT entered into by and between the CITY OF DELRAY BEACH, a municipal corporation, hereinafter referred to as "Delray" and the TOWN OF HIGHLAND BEACH, a municipal corporation, hereinafter referred to as "Highland". WHEREAS Highland Beach lies entirely east of the Intracoastal Waterway; and WHEREAS a substantial portion of Delray lies east of the Intracoastal Waterway; and WHEREAS both municipalities desire to guard against the potential danger of failure of water service east of the Intracoastal Waterway;~ ~ NOW, THEREFORE, be it agreed as follows.' 1. Highland will cause to he made one connection of the water systems of Delray and Highland in accordance with specifications provided by Delray. 2. The parties hereto will divide' the cost of such connection equally. The connection will be controlled by two valves, one of which is operable Highland and one of which is operable by Delray. 3. In the event that there is a failure of water service in Highland s that an emergency exists, or in the event of a water system failure in Delray east of the Intracoastal Waterway so that an emergency exists, the valves in question will be opened so as to permit Highland to use Delray's water, or to permit Delray to use Highland's water, as the case may be. 4. For the purposes of this agreement, it shall be presumed that water is used at the rate of forty thousand gallons per hour. The "using party" sh_~_l] recompense the "providing party" at the rate of twenty-five cents -.~ (25~) per thousand gallons. 5. In case of an emergency, a letter from the City Manager or Town Administrator setting forth the emergency and estimated time of use shall be delivered to the other party. The letter shall be authority for the party addressed to open their valve. A letter directing the shut off of the valve after the emergency shall be served by the using party. Such letter shall be evidence of the time involved for billing for the use of the water. 6. This Agreement may be terminated by either party on 30 days' notice by delivery of an executed resolution of such termination passed by the council at a regular meeting.
