Res 57-70 RESOLUTION NO. 57-70. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF D~RAY BEACH, FLORIDA, ACCEPTING A PORTION OF A~A NO. 34 SANITARY SEWER PR~ECT KNOWN AS TROPIC PALMS, 1st PHASE SEWAGE COLLECTION SYS- TEM, AS COMPLETED BY THE FIRST FEDERAL SAVINGS AND LOAN ASSOCIATION OF MIAMI AS OPERATIONAL AND CONFIRMING THE EFFECTIVE DATE FOR THE INI- TIAL SCHEDULE OF RATES, FEES AND OTHER CHARGES TO BE IMPOSED FOR THE SERVICES AND FACILITIES F~NISHED BY SAID PORTION OF AREA NO. 34 OF THE SEWER SYSTEM. WHE~AS, the Ci~ Engineer has certified as operational the fol- lowing described portion of Area No. 34 Sanitary Sewer Project known as Tropic Palms, 1st Phase Sewage Collection System, as completed by the First Federal Savings and Loan Association of Mi~i: Curlew Road from Lindell Boulevard to East end of Curlew Road; Jaeger Drive from Curlew Road to Albatross Road; Kin~ird Circle from Curlew Road to Albatross Road; and Linnet Circle from Curlew Road to Albatross Road WHEREAS, it was deemed by Council, at its regular meeting on February 24, 1970, to be in the best interest of the affected proper- ties that the initial schedule of rates, fees and other charges to be imposed for the services and facilities furnished by the sewer system, as set forth and contained in Resolution No. 1359, Ordinance No. G-553, Ordinance No. 30-68 and Ordinance No. 28-69, to become effective on the first day of April, 1970. NOW, THEREFOr, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF D~RAY BEACH, FLORIDA, AS FOLLOWS: 1. That the portion of Area No. 34 Sanitary Sewer Project known as Tropic Palms, 1st Phase Sewage Collection System, as completed by the First Federal Savings and Loan Association of Miami is hereby ac- cepted by the City as being operational, and the initial schedule of rates, fees and other charges previously established, and applicable thereto, being effective as stated above. 2. That nothing herein contained shall be construed as discharg- ing the contractor from the strict performance of his remaining con- tractual duties. That the contractor, and his bonding companies, re- main res~nsible in all respects until released in accordance with his contractual agreement. PASSED AND ADOPTED this 14th day of September, 1970. Yates City Clerk City of Delray Beach Delray Beach, Florida Dear Mrs. Yates: Mr. Christianson advised me Friday that you required a letter from us requesting the formal acceptance of the sewer systems installed at our expense in the Tropic Palm area. I am there- fore requesting that the City of Delray Beach accept that por- tion of the sewer installed under the title of "Sewage Works Project Tropic Palm Main 34, laterals 34-E, 34-I" under file #5964-8D. This line is that portion constructed in conjunc- tion with the City's Cambron job, and completed by American Fire and Casualty Company. ~____. I am also,requesting that the City accept that collection system referred to as Tropic Palm, 1st Phase Sewage Collection System, Delray Beach, Florida. This line was the one as en- gineered by Winningham and Lively, Inc and constructed by Tropic Builders of Delray Beach, Florida, at the expense of First Federal Savings and Loan Association of Miami.
