Res 14-69 RESOLUTION NO. 14-69. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, IN PALM BEACH COUN- TY, FLORIDA, AMENDING SECTION 47 THEREOF PROVIDING THAT THE PERSON APPOINTED AS MUNICIPAL JUDGE SHALL BE A MEMBER IN GOOD STANDING OF THE FLORIDA BAR WITH AT LEAST TWO YEARS' EXPERIENCE AS A PRACTICING ATTORNEY IN FLORIDA, AND OTHER QUALIFICA- TIONS AS ESTABLISHED BY ORDINANCE AT THE TIME OF HIS APPOINTMENT. ~EREAS, the Charter provisions of the City of Delray Beach, Florida, need modernizing as it pertains to the municipal judge to provide for stricter qualifications; ~E4EREAS, notice of intention to apply for a local bill was presented and heard on the February 11, 1969, clinic agenda of the Palm Beach County Legislative Delegation; WHEREAS, a public hearing was held on April 28, 1969, after 10 days public notice pursuant to the Charter of the City of Delray Beach, Florida; ~EtEREAS, it is deemed to be in the best interest of the City of Delray Beach, Florida, that the qualifications of the municipal judge should be more demanding; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA: The Legislature of the State of Florida is respectfully re- quested to enact in the 1969 regular session an amendment to Sec. 47 of the Charter of the City of Delray Beach, which is approved and recommended by the City Council of the City of Delray Beach, Florida, a copy of said amendment being submitted herewith. That Section 47 of Chapter 25786, Special 18 Laws of Florida, Acts of 1949, as amended, same being the 19 Charter of the City of Delray Beach, Florida, is amended to 2O read as follows: 21 There shall be and there is hereby established in the City 22 of Delray Beach a municipal court, to be known as The l¥Iunicipal Court of the City of Delray Beach, Florida, for 25 the trial of offenders against the municipal ordinances. Such 26 court shall be presided over by 27 Gi~ingl~% Municipal Judge Ernest G. Simon, who shall serve until the first IVIonday in January, ~952, 1970, at which time ~9 3o 31 I the members of the city council at their regular meeting on the 2 first ~ionday in January, ~:952, 1970, and annually thereafter, 3 will appoint a municipal judge whose term of office thereafter shall be for one year. Applications shall no~ be received by,he city council for such position. In case 16 of the absence or disqualification of or disability of the 17 municipal judge, the city council may designate some other !8 person to acZ during such absence, sickness or disqualification. i9 Compensation to be paid said municipal judge shall be fixed by ordinance or resolution. Sessions of the municipal court may 21 ~ be held daily except on Sundays and holidays. 22 · Section 2. Ail laws or parts of laws in co~lict herewith 24 are hereby repealed. 25 Section 3. It is declared to be the legislative intent that ii 26 any portion of the Act is held invalid, the remaining provisions 27 of this Act shall not be affected but shall remain in full force and effect. 31 2 i Section 4.
