A RESOLUTION OF T~E CITY COUNCIL OF T~E CITY
OF DELRAY BEACH, FLORIDA, ORDERING THE OPEN-
ING, GRADING AND PAVING OF THAT PART OF NORTH-
EAST SEVENTH COURT LYING BETWEEN SEVENTH AND
EIGHTH AVENUES A DISTANCE OF TWO BUNDRED THIRTY-
FIVE (235) FEET.
WHEREAS, the City Council of the City of Delray Beach,
Florida, did, on the 24th day of July, 1967, adopt Resolution
No. 14-67 ordering the City Manager to prepare plans and speci-
fications, together with estimate of cost of opening, grading
and paving of that part of Northeast Seventh Court lying between
Seventh and Eighth Avenues a distance of two hundred thirty-five
(235) feet to a width of twenty-four (24) feet, and requiring
said plans, specifications and estimate of cost of such improve-
ment to be placed on file in the office of the City Manager, and
WHEREAS, the City Council deems it to be necessary for
the safety and convenience of the public to open, grade and pave
said street.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Delray Beach, Florida, that it is determined to make
the following described improvement, to-wit:
To Open, Grade and Pave that part of North-
east Seventh Court lying between Seventh and
Eighth Avenues a distance of two hundred thir-
ty-five (235} feet to a width of twenty-four
(24) feet, the total cost as estimated, for
such improvement being $ 2,200.00.
BE IT FURTHER RESOLVED that the entire cost of such im-
provement shall be shared by the City of Delray Beach, Florida,
and the following described properties in Delray Beach, Palm
Beach County, Florida, on a basis of the City of Delray Beach
paying twenty (20) per cent of the cost of said improvement and
the abutting property owners, said properties shown below, paying
eighty (80) per cent of said total cost, by special assessment.

said benefits to be determined and prorated according to the front
footage of the respective properties as set forth immediately
above.

BE IT FURT~R RESOLVED that said special assessments
against all the parcels of lands as set forth above which are
specially benefited, shall be and remain liens superior in dig-
nity to all other liens, except liens for taxes, until paid, from
the date of the assessment upon the respective lots and parcels of
land assessed, and which shall bear interest at the rate of eight
(8) per cent per annum, and which may be paid in three (3) equal
yearly installments with accrued interest on all deferred payments.
Payment shall be made at the same place that taxes payable to the
City of Delray Beach, Florida, are paid, namely the office of the
City Tax Collector, and upon failure of any property owner to pay
the annual installment due, or any annual interest upon deferred
payments, the City of Delray Beach may bring necessary legal pro-
ceedings by a Bill in Chancery to enforce payment thereof with
all accrued interest, together with all legal costs incurred, in-
cluding a reasonable attorney's fee. The total amount of any lien
may be paid in full at any time with interest from the date of
assessment.
IT IS ORDERED that the City Council shall sit at the
City Hall in the City of Delray Beach, Florida, at 8:00 P.M. on
the 28th day of August , 1967, for the purpose of hearing ob-
jections, if any, on said proposed improvement, as set forth above.
PASSED AND ADOPTED by the City Council of the City of
Delray Beach, Florida on this the 14thday of August , 1967.

Proposed Paving of N.E. 7th Court
Between N~. 7th and 8th ~venue.
The R/~ of N.~. 7th Court between N.E. 7th and 8th Avenues
is 40 feet wide and 235 feet long.. The present pave,~ent of
each avenue is 10 feet from the ~/W line thus making 7th Court
255 feet in length.
There is shell rock in the ~/W which averages 6 inches deep
and 18 feet wide, except for 75 feet at the west end which is
mostly sand. The center line of the shell rock drive is six
feet South of the R/W centerline. ~ith the exception of the
west end, the shell rock is below grade but could be used as a
part of the base stabilization. The west end is above grade
and the shell rock is too thin to be salvaged; therefore,it
will have to be removed and a proper grade established with
new rock.
The R/W between the two avenues is bounded by five lots
on each side. It provides the only access to the four apart-
ments in the two buildings on the South side. There are no
buildings on the North side.
The approximate cost o£ paving this one block with City
forces and equipment will be ~ 1584. making a cost of ~3.37
per lineal foot for each piece of property.
If a contract is awarded for the project, the estimated
cost will be $2174 or ~4.63 per lineal foot for each property.
Both of the above estimates include engineering costs of
$ 284. which is 15~ of the estimated contract price.
Proposed Paving of N.~ 7th Court between
N.E. 6th ~venue(Northbound ~.S.1) and
7th ~venue
The R/W of N.~. th Court is 40 feet wode and 296 feet
long including the 10 feet of unpaved R/W on 7th avenue.
The intersection at 'U.S. ~1 is paved to the ~ast boundary
line.
The R/W is obstructed on the West end by a circular planting
of shrubs surrounded by rock boulders. The Lorne-Babione
Funeral Parlor's paved parking area extends 23 feet into the
North half of the R/W and is bordered by small palm trees,
sh~'ubbery and electrical outlets for floodlights. The parking
area is 233 feet long and is about one foot above street
elevation. The remainder of the R/W is clear and level, thus
it would require a minimum of grading prior to paving.
The R/W is bounded by 12 lots, all six lots on the North
side are owned by Lorne-Babione. The first three lots East of
6th Avenue on the South side are owned by the Humble 0il Co,
the remaining three lots are owned by 2 individuals.
The estimated cost of City. labor and equipment for clearing
and grading the R/W would be $ 250.00 and thercost of paving
would be ~ 450.00.

The approximate cost of materials for paving this one
block 22 feet wide would be ~ 895.00 making a total cost
of ~ 1595.00.
If a contract is warded for this work. the estimated
cost would be ~ 2060.00.
Recommendation:
That a contract be awarded for paving that part of
N~E. 7th Court between N.Eo 7th and 8th avenues and that no action
be taken at this time to pave that portion between 6th and 7th
avenues.
This will provide permanent access and egress to the imp-
roved property and enhance the value of the remaining vacant
lots.
There is no apparent advantage in paving 7th Court between
6th and 7th avenues except that it will provide direct access
to the highway.
