Res 38-66 RESOLUTION NO. 38-66 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, VACATING AND ABANDONING THAT PORTION OF NORTHEAST FIFTH STREET EXTENDING WESTERLY FROM NORTH- EAST FIFTH AVENUE TO THE EASTERLY LINE OF THE FLORIDA EAST COAST RAILROAD RIGHT-OF- WAY. WHEREAS, the right-of-way described above has not been opened or developed, and WHEREAS, LEON M. WEEKS, AS TRUSTEE for the owners of the properties abutting said right-of-way requested the vacation and abandonment thereof as said right-of-way is no longer required for providing egress and ingress to any lands. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA: That pursuant to Section Seven (7), Paragraph Three (3) of the Charter for the City of Delray Beach, Florida, and SUBJECT to the City being furnished a properly executed EASE- MENT DEED over the West ten (10) feet of the described right- of-way, such EASEMENT being required for public utility pur- poses, we do hereby declare the following right-of-way in the City of Delray Beach, Florida, to be vacated and abandoned: That portion of Northeast Fifth Street extending Westerly from Northeast Fifth Avenue to the Easterly line of the Florida East Coast Railroad right-of- way.
